This constant rangling over enforcement jurisdiction is why we need to replace "The Clean Water Act," which is just a set of amendments to a pollution control act and therefore about limiting dirty water, not ensuring clean water, with a Right to Clean Water and then define clean water. Then states would have to enforce it on their own. It's inane that clean water isn't a basic federally protected right in the US.

SCOTUS Ruling Weakens Clean Water Act

The United States Supreme Court today ruled that the Clean Water Act does not allow the Environmental Protection Agency to regulate some wetlands near bodies of protected waters. The court determined that the law covers only wetlands “with a continuous surface connection” to protected waters, even though they may be part of the same greater ecosystem or have been artificially separated by human-made barriers.
