Ex-Kansas police chief charged over newspaper raid

A former central Kansas police chief who led a raid last year on a weekly newspaper has been charged with felony obstruction of justice. Former Marion Police Chief Gideon Cody is accused of persuading a potential witness for an investigation into his conduct of withholding information from authorities. The single charge alleges Cody's actions occurred on the day of the raid of the Marion County Record or sometime within the following six days. The charge had been filed Monday in state district court in Marion County. A business owner who was a potential witness in the investigation of Cody's conduct has said he asked her to delete texts between them. The Associated Press left a message seeking comment at a possible cellphone number for Cody.

In what should be the most obvious ruling in the world, the CA Supreme Court has ruled that trying to avoid contact with the police is not probable cause for the police to detain you. Duh.

"But before an officer can compel compliance with a show of authority... articulable facts must support a reasonable suspicion of criminal activity. In the absence of such facts, the person is constitutionally protected and empowered to go on his or her way."

The cops don't like this, but that's too damned bad. People have a right to be out in public and to be left alone to go about their business if they're not doing anything illegal. I don't care how butthurt a cop might feel about that person existing outdoors.
