#OnionLake #CreeNation to proceed with its legal challenge of #Alberta sovereignty act

By Lisa Johnson The Canadian Press, May 15, 2025

EDMONTON - "Alberta’s bill lowering the bar for a separation referendum has spurred a #FirstNation to push ahead with a legal challenge against the premier’s flagship sovereignty act.

"Danielle Smith has said her Alberta Sovereignty Within a United Canada Act is needed to push back on what the province believes is unconstitutional federal encroachment into provincial jurisdiction.

"But Onion Lake Cree Nation Chief #HenryLewis said that law has always been about undermining federal authority and asserting provincial control, which goes against his community’s #Treaty6 relationship with the Crown.

" 'I want to respectfully remind the premier that this land that we stand on today is #Treaty land and is not yours to take or make sweeping decisions about,” he said at a news conference in Edmonton on Thursday.

"He announced the legal challenge is moving forward a day after Smith’s government passed a bill significantly lowering the threshold for citizens to prompt a referendum, including one on seceding from Canada."

"The #SturgeonLakeCreeNation has filed a legal claim challenging the approval of a separatist petition in #Alberta, arguing that any move toward separation from Canada cannot proceed without the consent of #FirstNations.

"In a statement released Friday, the First Nation said it has filed a Statement of Claim in the Alberta Court of King’s Bench against the Alberta government, the federal government and Alberta’s Chief Electoral Officer.

"The claim alleges a failure to uphold and implement Treaty No. 8 and argues the approval of the petition violates treaty rights."

"The watershed is located in #Treaty8 territory and across the #Métis Nation of #Alberta Regions 4, 5, and 6. Almost 175,000 people live along the 1,900 kilometers of rivers that flow north into the Northwest Territories. The nearest #FirstNation to the project, #SturgeonLake #CreeNation, wrote an open “cease and desist” letter to Alberta’s premier saying it learned of the project through the media."

#SturgeonLake #CreeNation (#SLCN) Chief Sheldon Sunshine said he learned about the project through social media, despite the project being proposed for the Nation’s traditional lands.

“It seems like it was all worked on well before us, and then we’re an afterthought, and it should never be that way,” said Sunshine in an interview.
