If #Biden really wanted to honor the Constitution, he'd get his DOJ to sue to enforce Section 3 of the 14th Amendment, which says that anyone who's previously taken an oath to uphold the Constitution and subsequently "engages in insurrection or rebellion" is disqualified from holding public office.
This could even be a class action suit filed by organizations devoted to protecting our rights. #usa #Constitution

But according to Section 3 of the 14th Amendment, he CAN be prohibited from "serving," i.e., holding office because he had already had taken an oath of office and subsequently "ENGAGED IN insurrection or rebellion." He doesn't need to be indicted, prosecuted, or convicted, but he DID incite a rebellion and then watched and approved. We all witnessed what he did.
So, what, the 6 Republican hacks on #SCOTUS can't read and understand English? 14(3) is a helluva lot clearer than the 2nd Amendment, but SCOTUS and their patrons sure don't seem to have any problems interpreting that to give gun manufacturers the world. I've read it many times. There's no doubt it applies to Trump AND his Sedition Caucus. However, it doesn't say anything about him being prohibited from running--it just says that anyone who's engaged in insurrection after having taken an oath to protect the Constitution is prohibited from holding office. #14thAmendmentSec3

The Colorado State Supreme Court ruled that Trump is not eligible to be on the ballot. Trump appealed to the U.S. Supreme Court and that court will hear oral argument February 8.
The parties that filed the lawsuit seeking to have Trump declared ineligible have now filed their brief with the U.S. Supreme Court.

I just read it and while I am not an attorney this sure seems like strong and well-presented work. Hard to see how the U.S. Supreme Court can wiggle out of this and let Trump be on the ballot.
