The Colorado State Supreme Court ruled that Trump is not eligible to be on the ballot. Trump appealed to the U.S. Supreme Court and that court will hear oral argument February 8.

The parties that filed the lawsuit seeking to have Trump declared ineligible have now filed their brief with the U.S. Supreme Court.

I just read it and while I am not an attorney this sure seems like strong and well-presented work. Hard to see how the U.S. Supreme Court can wiggle out of this and let Trump be on the ballot.

Colorado judge strikes down Trump's attempt to toss a lawsuit seeking to bar him from the ballot

A Colorado judge has rejected an attempt by former President Donald Trump to dismiss a lawsuit that seeks to keep him off the state ballot. The lawsuit claims the U.S. Constitution's ban on those who have “engaged in insurrection” from holding office applies to Trump, citing his role in the Jan. 6, 2021, attack on the U.S. Capitol. Trump’s attorneys argued the case should be dismissed because of a Colorado law that protects people from lawsuits abridging their free speech rights. State District Judge Sarah Wallace ruled that the law doesn't apply in this case.

The language of insurrection: Legal bids to remove Trump from 2024 ballot barrel forward

Two years after the tradition of America’s peaceful transfer of presidential power was broken, the question of whether Donald Trump should remain on the ballot in 2024 looms large.

Law & Crime

*Two* different ways that the #14thAmendment bars a person from being President. See the screenshot below with my highlighting.

If Trump gave “aid or comfort to the enemies thereof” then he is not eligible to be president. It is not necessary to prove that Trump engaged in insurrection.

I suspect the “aid or comfort” criteria is a lower bar. Unless you read the complaint in any of the #14thAmendmentSec3 lawsuits you cannot be certain which criteria is being alleged.
