I wrote this in 2011, when Gov. Jerry Brown was trying to negotiate with Republican legislators to put a tax measure on the ballot. With the exception of some small California particularities, it’s pretty much the same playbook Republicans are using against everyone (including themselves) today.
Silver linings? Pretty darn few, but I’d say the odds are solid that as a trustee he’ll wind up a defendant in First Amendment litigation, given his fervent support for unconstitutional speech restrictions.

In my vain effort to have people understand me and what I am ranting about, I try to clarify to commonly misunderstood First Amendment phrases: “First Amendment exception” and “this is a First Amendment issue.”
