Il 30 marzo la Knesset ha approvato con 62 voti contro 48 la legge che introduce la pena di morte per impiccagione dei palestinesi condannati per omicidio in Cisgiordania occupata. Il provvedimento entra in vigore tra trenta giorni. Netanyahu ha votato a favore. Ben Gvir, che ha guidato la campagna, ha stappato champagne in aula. «Abbiamo fatto la storia», ha scritto sui social.
Il testo garantisce l’anonimato alle guardie carcerarie designate come esecutori e assicura loro l’immunità legale. I colloqui tra condannati e avvocati sono ridotti a videochiamate. L’esecuzione avviene entro novanta giorni dalla condanna. I tribunali militari della Cisgiordania occupata giudicano esclusivamente palestinesi: i coloni israeliani restano sotto i tribunali civili. La pena capitale è la sentenza predefinita, salvo circostanze eccezionali.
L’ufficio ONU per i diritti umani nei Territori Palestinesi Occupati ha dichiarato il 31 marzo che la legge «rafforza la violazione del divieto di segregazione razziale e apartheid». Human Rights Watch ha definito il doppio binario «tratto caratteristico dell’apartheid». Amnesty International ha collegato la norma alle assoluzioni dei soldati per gli abusi nel centro di detenzione di Sde Teiman. «Per anni abbiamo assistito a esecuzioni extragiudiziali con i responsabili che godevano di quasi totale impunità», ha dichiarato Erika Guevara-Rosas di Amnesty International. «Questa legge è il culmine di tali politiche.»
Al 31 marzo 9.500 palestinesi si trovavano detenuti nelle carceri israeliane, tra cui 350 minori e 73 donne. Circa la metà è in detenzione amministrativa o classificata come «combattente illegale»: nessun processo, nessuna difesa possibile. La legge non è retroattiva. Chi ucciderà domani potrà essere impiccato da un esecutore senza nome.

On March 30, the Knesset passed with 62 votes against 48 the law introducing the death penalty by hanging for Palestinian prisoners convicted of murder in the occupied West Bank. The measure will take effect in thirty days. Netanyahu voted in favor. Ben Gvir, who led the campaign, popped champagne in the chamber. “We made history,” he wrote on social media.

The text guarantees anonymity to designated guards who will carry out the executions and ensures them legal immunity. Meetings between prisoners and lawyers are reduced to video calls. The execution takes place within ninety days of the conviction. Military courts in the occupied West Bank judge only Palestinians: Israeli settlers remain under civil courts. The death penalty is the default sentence, except for exceptional circumstances.

The UN Human Rights Office for the Occupied Palestinian Territories declared on March 31 that the law “strengthens the violation of the ban on racial segregation and apartheid.” Human Rights Watch has called the dual system “a characteristic feature of apartheid.” Amnesty International has linked the rule to the acquittals of soldiers for abuses at the Sde Teiman detention center. “For years we have witnessed extrajudicial executions with almost total impunity for the perpetrators,” said Erika Guevara-Rosas of Amnesty International. “This law is the culmination of such policies.”

As of March 31, 9,500 Palestinians were imprisoned in Israeli jails, including 350 minors and 73 women. Approximately half are held under administrative detention or classified as “illegal combatants”: no trial, no defense possible. The law is not retroactive. Whoever kills tomorrow can be hanged by an anonymous executor.
