LA NOTIZIA: Israele impone la pena di morte per i palestinesi, l’Europa condanna

Nelle ore in cui è stato impedito al cardinale Pierbattista Pizzaballa di celebrare la Domenica delle Palme al Santo Sepolcro, Israele riesce a farsi condannare dai suoi principali partner anche per la volontà di introdurre la pena di morte per i terroristi palestinesi. Dopo il passo indietro del governo di Benjamin Netanyahu sulle celebrazioni al Santo Sepolcro, Tel Aviv finisce di nuovo nella bufera con la lettera inviata da quattro governi europei – Italia, Germania, Francia e Regno Unito – che chiedono a Israele di ritirare il disegno di legge che introduce la pena di morte per i cittadini palestinesi condannati per terrorismo.

Ma il Parlamento israeliano ha tirato dritto, ignorato i richiami internazionali e ha approvato ieri sera la legge. Il disegno di legge prevede che i condannati a morte per terrorismo saranno detenuti in strutture inaccessibili ed entro 90 giorni dalla sentenza arriverà l’esecuzione che dovrebbe essere per impiccagione, anche se il ministro Itamar Ben-Gvir non esclude il ricorso all’eutanasia e alla sedia elettrica. Per i quattro governi europei si tratta di un disegno di legge “carattere discriminatorio”, come scrivono in una nota i ministri degli Esteri.
“L’adozione del provvedimento rischia di minare gli impegni in materia di principi democratici”, proseguono ribadendo che “il rifiuto della pena di morte è un valore fondamentale che ci unisce”. Un appello che si unisce a quelli degli esperti dei diritti umani delle Nazioni Unite. Se la legge entrasse in vigore, inoltre, verrebbero traditi gli impegni assunti da Israele a partire dal 2007 sulle risoluzioni Onu che chiedono una moratoria sulle esecuzioni. Ma tanto, ormai si sa, il diritto internazionale vale ma solo fino a un certo punto.

For the four European governments, it is a bill “of discriminatory character,” as the Foreign Ministers write in a note.

“The adoption of this measure risks undermining commitments on democratic principles,” they continue, reiterating that “the rejection of the death penalty is a fundamental value that unites us.” An appeal that joins those of the UN human rights experts. Furthermore, if the law were to come into force, Israel’s commitments since 2007 on UN resolutions calling for a moratorium on executions would be betrayed. But as we know, international law is worth something, but only to a certain extent.
