@november @JohnnieMac @QasimRashid The failure to indict does not protect the father from another run at an indictment for murder or manslaughter by the current DA, or the next DA, or the next, for the rest of the father's life. They say that prosecutors can present evidence to a jury that would indict a ham sandwich. The reverse may said for going through the motions but failing to indict a killer for manslaughter or murder.

@Johns_priv @QasimRashid The only witness is the survivor, who’s a drunk who bought a gun and didn’t bother to get trained in how to use it. It’s unfortunately completely believable that he accidentally shot her trying to prove he was storing it safely, which seems to be what started the argument, with the Trump conflict being an exacerbating factor.

The prosecution should have pursued other charges, though. Reckless endangerment comes to mind, but NAL.

@QasimRashid Given the article @Steve_Holcombe provided, it would appear that (a) they argued/talked about something, (b) the "white MAGA man" had consumed 500 ml of wine, but claimed it was not a factor while police could smell alcohol on his breath after the shooting, and (c) he claimed the gun went off by accident.

So, one question I would add is why do we allow people to have guns without any sort of testing/licensing to show that they can handle them competently - like we do with cars.

While the fact that they apparently argued about Trump before the gun was fired, it's far from clear that the argument was the reason the gun was fired.

It seems awfully premature to say much of anything about what actually happened.

Possibly so, based upon publicly available info. But murder has no statute of limitations. The father will never be "off the hook" for the remainder of his life.

Curiously, "white privilege" didn't prevent a friend from once getting a ticket for an "open container" when he was sitting in his
parked car's passenger seat, engine off, keys out of the ignition, both doors open, and both feet on the ground while eating a sandwich and drinking one beer.

The "white privilege" card is sometimes imperfectly played within the crevices of the criminal justice system. By that I mean to say that racism is a statistical fact within criminal justice. Though white privilege is of course not a legal defense.

Based upon the publicly available information, not less than manslaughter should be seriously considered. And I'm speaking as a former state prosecutor who has personally tried a "drunk killing" occuring in an alley, behind a bar.

Did we read the same article? She hated guns and he knew it. She had argued with him about whether or not it would hypothetically be okay for Trump to sexually assault her (he was fine with it).

His explanation was that he had revealed to her for the the first time that he had a gun and was showing it to her, whereas witnesses say she frequently became upset when he mentioned his gun in the past.

It was a pre-meditated execution using alcoholism as an excuse.
