JUST IN: A federal judge in #Texas, appointed by Donald #Trump, will allow those targeted by the Alien Enemies Act in South Texas to proceed with a class action against the government. https://storage.courtlistener.com/recap/gov.uscourts.txsd.2000771/gov.uscourts.txsd.2000771.57.0_1.pdf

Here we have it. The FIRST ruling on the SUBSTANCE of Trump‘s interpretation of the alien enemies act. Judge appointed by Trump in Texas strikes it down as UNLAWFUL. Sup court will eventually resolve, but couldn’t have a better harbinger. And of course it’s accurate – the Admin reading is fanciful.

JUST NOW: Judge Rodriguez also denied an effort by the Trump administration to hurriedly deport *today* one of those AEA targets, Daniel Zacarias Matos, under other immigraiton authorities. He wants briefing on the matter and needs to consider jurisdiction.

@GottaLaff Isn't the "alien enemy act" only lawful if there was a state of emergency or war within the USA?

@energisch_
Yes, and the judge noticed that!

@Osteopenia_Powers @energisch_ @GottaLaff

Trump is the state of emergency in the USA.

@GottaLaff
Little suggestion here. How about the ACLU take over the DOJ? They seem to have more interest in the rule of law than the #FOTUS admin has.
@GottaLaff
Sorry Laffy, I wasn't being serious about them actually taking over but when we look at what the DOJ are doing it seems to me that the ACLU are far better at knowing and applying the correct legislation and persuading even conservative judges that Trump and his admin haven't a clue about how to do it.
@GottaLaff “Fanciful” is so diminishing. 😻
@GottaLaff
😁
PS, how's your arm/shoulder/wrist?
@GottaLaff Without downplaying how important and positive this ruling is, I still find myself in a twist over the lack of accountability so far when Trump and his cabal ignore judicial orders. Once I see someone in the administration actually punished for defying a judge's ruling will I have a reason to feel some relief.

@GottaLaff unfortunately, in July 1, 2024, in Trump v. United States, #SCOTUS determined #trump has broad powers to break laws with immunity… that means he can ignore the courts.

I don’t think SCOTUS thought that one through
