Again Musk fails to show up to court. His lawyers have chosen an odd - to say the least -strategy to defend against the first count of the case against him. That count contends that the 1 million voter sweepstakes he has been running is an illegal lottery. Musk’s lawyers are saying that bc the winners have not been chosen at random, the operation isn’t a lottery. Problem for them: Musk and his PAC kept saying explicitly in tweets that winners would be chosen at random. https://www.inquirer.com/politics/larry-krasner-lawsuit-elon-musk-hearing-20241104.html 1/
Philly DA’s lawsuit against Elon Musk to get its day in court Monday

Whether the tech billionaire will show up is an open question — as is the fate of DA Larry Krasner’s lawsuit against Musk and his political action committee.

The Philadelphia Inquirer
Making the argument that the $1 million giveaway recipients are not chosen at random when Musk and his PAC repeatedly said they would be runs right into the second count against Musk and the PAC, which alleges they violated consumer protection laws by misleading and lying to participants. 2/2

@heidilifeldman

Felon Musk sounds about right imho

@heidilifeldman liars can’t help themselves.
@heidilifeldman I haven't read the lawsuit. Are they trying to stall until the issue becomes moot, or is there the possibility of relief even after the election?
@msbellows The consumer protection claim wouldn’t become moot, I am pretty sure. Less sure about the illegal lottery claim, which includes abatement as a remedy, which obviously would be moot after the election - but I don’t remember just now the other remedies sought on that count.
@heidilifeldman withdraw his illegal citizenship and deport the turd. He’s here based on lies. Time to remove a criminal from our midst.

@sigsegv @heidilifeldman
😂 "... deport the turd"

Yeah, not only is that Never going to happen, if Trump is elected he'll part of the Cabinet.

@heidilifeldman Does it count as political prosecution if you have to get your protector into office in order to avoid lawful prosecution?
So now I know I couldn't shill for one of those checks even if I tried because they're predetermined and that the other party is lying to voters to get them to vote and to not vote depending on the voter demographic.
@heidilifeldman So it's DOUBLY ILLEGAL?!?!?!
@ai6yr @heidilifeldman
musk has built an entire career arc on flouting the law, so I'm going to guess that "doubly illegal" is only the tip of the iceberg.
@heidilifeldman wow these lawyers must know they were handed a sh$t sandwich but guessing they're totally fine with that
@heidilifeldman n.b. that the terms "sweepstakes" and "lottery" are explicitly not equivalent under US law; this is indeed the entire argument under the first count of the indictment. It may be better to use a different word (but I am not the boss of you so also it seems fine to ignore me, because I also kinda suppose you've had this conversation already. Sorry.)

@heidilifeldman

A lottery where you must pass MAGAT tests to qualify as a participant is still a lottery.

@heidilifeldman
So, not a lottery, just a fraud?
@heidilifeldman Is the idea to basically admit to federal wire fraud, in order to get the illegal lottery charge thrown out and eventually the federal charge dropped if Trump wins? Backdooring his way back into the jurisdiction change?

@heidilifeldman

Maybe someone needs to take away his citizenship…

@heidilifeldman Bet the ones 'chosen' couldn't even cash the fake check. Someone needs to tell the MAGGAts that Musty is cheating them just like Bannon cheated them on the wall.
@heidilifeldman Fortunately for Musk, the law in the US is different for the rich and well connected.
@heidilifeldman Does a person get in trouble for not showing up in court?
@Julie In civil litigation, the penalties are usually fines. Of course, the amounts stipulated by law are not ones Musk cares about. And he has no shame in breaking the law.

@heidilifeldman @Julie

I think it's Denmark that scales traffic fines with personal income. That's starting to sound more and more appealing.

@heidilifeldman
Nothing like elevating a minor civil suit to a felony.
@heidilifeldman We're not running a lottery, we're just perpetrating a fraud. Great argument.
@heidilifeldman I hope Trump loses by a land slide and they both go to jail. That would be such a cherry on top!

@heidilifeldman

So it's fraud not an illegal lottery?

Trump is going to lose and Musk is cooked.

@heidilifeldman @briankrebs send the fucking Marshals for his traitorist ass.
@heidilifeldman It's almost like he is actually trying to get arrested.
@heidilifeldman he'll be fine, as long as Trump takes power, just like Trump himself. I don't know what he has got in the way of fall-back strategies, probably just fighting it for years with expensive lawyers and getting the Supreme Court to throw it out.
@heidilifeldman It’s clear that these evil rich men do not fear the law…
