Texas Governor Abbott signals that he may (will?) defy the Supreme Court order regarding the border.

In 1830, Andrew Jackson, as president, refused to heed a Supreme Court order regarding the removal of Native Americans from Georgia.

Jackson's refusal gave us the Trail of Tears.

Jackson remained popular.

The similarity: Both defiances are deeply racist.

The difference: In 1830 only white men could vote.

Governor Abbott signals potential defiance of Supreme Court’s border ruling

Governor Greg Abbott issued a “Statement on Texas’ Constitutional Right to Self-Defense,” following calls by numerous Republican lawmakers to resist the high court’s order, including three state representatives from Houston.

@Teri_Kanefield Jackson was president. Abbott is a state governor. So what can Biden legally do? Seize control of the #Texas National Guard?

@BruceMirken @Teri_Kanefield

From the article:
"They can nationalize the Texas (National) Guard," Charles "Rocky" Rhodes said, "which is what happened in Arkansas, when the governor there tried to defy court orders to allow individuals who were Black to be able to attend white schools (in Little Rock in 1957)."

President Eisenhower sent the 101st Airborne Division to Little Rock and federalized the Arkansas National Guard.

Abbott would do well not to push President Biden too far.

@joeinwynnewood @Teri_Kanefield I hope Joe does it. Time for some hardball.
@Teri_Kanefield time to mobilize the regular army. To get Abbott’s attention

@markrsmith Posse Comitatus says no

Biden could call TX Nat Guard into national service and order them to stand down, I think.

Teri?

@Teri_Kanefield

Texas Democrat calls on Biden to seize control of Texas National Guard

Rep. Joaquin Castro (D-Texas) is calling on President Biden to take control of the Texas National Guard if the state defies a Supreme Court ruling that allows U.S. Border Patrol officers to take down the border barriers. “Governor Greg Abbott is using the Texas National Guard to obstruct and create chaos at the border. If…

The Hill
@weezmgk @Teri_Kanefield I didn’t say into action. Just move some soldiers to a Texas base near the border.
@markrsmith 'near' the border is more complicated than ON the border. @Teri_Kanefield
@Teri_Kanefield Another difference. This is interfering by force with law enforcement officials in the course of their duties. Legally, I suspect ICE could shoot the guard and rangers if they continue to get in their way Of course these are white men, not a 16 year old herding goats, or a 12 year old (maybe) throwing stones, so th ey won't use t he force they are legally entitled to use.

@GarLipow

Has Texas used force against federal officers?

@Teri_Kanefield @GarLipow From the WSJ: "On Jan. 12, Texas National Guardsmen blocked the agents from accessing the Rio Grande after Mexican authorities reported to their U.S. counterparts that two migrants were in distress in the river and that a woman and two children had drowned nearby earlier that evening, the government said in court papers."

It isn't clear just how the did the blocking, but seems they used the threat of violence to keep the Border Patrol from doing its job.

@Teri_Kanefield A move that is so cynical, so unnecessary, and likely going over really well with the average Texas voter :(
@Teri_Kanefield The comments here to your post are all interesting … but to me the most important and rather disturbing issue is the very statement that a governor is openly suggesting he might defy the Court. If that road is taken … we’re heading into dangerous territory.

@legallaurak My point was that it's happened before. It's only dangerous if the Republicans win the 2024 election.

Jackson won reelection and his VP won after him, and as a result, brutalities continued against Native Americans and Black Americans (he was an unrepentant enslaver)

@Teri_Kanefield All true, agree with that. So ... we "just" have to prevent us going down that road.

@legallaurak

What I've seen lately persuades me that Biden will win. Inviting Kate Cox to the State of the Union address was perfect.

When abortion has been an issue, Republicans lose.

@Teri_Kanefield It certainly has been going in that direction. I thought inviting Cox was excellent, too. But it's not a done deal until it's done. And we know Trump won't easily accept a loss. It's going to be a long year...
@legallaurak When I was researching and writing the biography of Andrew Jackson for my Making of America series I never dreamed that I'd start seeing so many parallels.
@Teri_Kanefield @legallaurak Yep, likely. Dobbs is an overreach. America is *so* lucky with the cognitive limitations of its enemies...
@Teri_Kanefield Wait, if states can just say "nuh-uh I do/dont believe that is in the consititution" to the supreme court - then what meaningful power do they have? Every state could just pick and choose what they want from its rulings... which means it no longer matters

@Guildz this is what Levitsky and Ziblatt mean by the guardrails and norms of democracy.

Andrew Jackson did it and got away with it because the voters (white and male) were with him.

I don't think this is going to go over well in November.

Adding: I profiled their book on my blog recently. The title is about fascism.

@Teri_Kanefield I also think having it come from the states is more significant. The only time this has happened before (as mentioned in the article) was desegregation of schools in alabama, which was forced upon it by federal officals.

That said, this feels different because federal officals are having to remove barbed wire while state officals are having to putting it back up. So the officals are either going to have to be arrested or nationalized or something.

Ultimately, this is a powder keg created over fox news/newsmax screeching and the "great replacement" conspiracy theory. They talk about immigrants as "foriegn invaders", in a classic case of dehumanization. I understand they believe anyone who isnt white isnt worthy of anything - but it still makes me want to shake these people and scream "immigrants are humans, it isnt that much relative to the size of the US and the border, stop freaking out over nothing".

God what a stupid hill to die on

@Teri_Kanefield

In Oklahoma, none of the native people want a 20 dollar bill. Won't touch it. They call it Black Heart's Money.

Andrew Jackson. America's Hitler.

@tuban_muzuru I have some stories.

Adding: I wrote a biography of Andrew Jackson for my Making of America series.

I received hate mail from a librarian in Tennessee who was furious that I portrayed their hero in such a bad light.

I asked her to show me where I was factually inaccurate and I would ask the publisher to issue a correction.

She wrote back again still spitting mad but pointed to no inaccuracy.

@Teri_Kanefield

The SCOTUS is, by dint of the varying demands of some of their numbers' benefactors, have found themselves backfiring their high water mark influence in national power.

@Teri_Kanefield When southern states defied desegregation orders, Eisenhower sent federal troops. Ideally it won't come to that, but it needs to be made clear to Texas that noncompliance isn't an option.
@Teri_Kanefield Texas is a treasonous shithole. Paxton is a friggin blatent felon.
@Teri_Kanefield That might be as distinction without a difference once Texas finishes disenfranchising its largest cities, replacing their elected governments with state-appointed administrators.
@Teri_Kanefield I think it needs to be made very clear that LEOs are not entitled to violate Constitutional rights in the course of enforcing the law. And yes, everyone on US soil has some measure of those rights. Torturing migrants isn't just gross, it's illegal in itself. The feds need to not just take over, but actually arrest the people doing this.
@Teri_Kanefield I don't know if I'm more bothered by
a) the idea that Abbott has huffed so much right-wing media that he's serious about this neoconfederate tantrum, or
b) by the idea that he cares so little about the country and its constitution that he'd readily turn against them as part of some cynical pandering to racists.

@Teri_Kanefield I suspect he's posing. He has to play the tough guy for his voters.

But I might be wrong. Maybe he's crazy enough to do something rash. In that case, I'd expect Biden, who doesn't have to play the tough guy, to shut it down in a way that won't give Abbott any oxygen, maybe through the courts or law enforcement.

@Teri_Kanefield Andrew Jackson was President. Francis R. Lubbock didn't fare so well when he tried it a Governor.

Maybe Joe is thinking of re-opening Fort Delaware.

@Teri_Kanefield

Abbott, Paxton, and Patrick are all jackasses. Texas deserves so much better.

@Teri_Kanefield Presidential immunity may be in question, but Abbot seems intent on running on a political platform of racism, bordering on genocide, and eugenics.

That's basically incriminating.

Let him signal his intentions.

@Teri_Kanefield

They are still trying to bring that back…

@Teri_Kanefield Either he wants to trigger a Civil War or he will prove that the Supreme Court rulings are not to be taken as law.

@Teri_Kanefield

So when the hell is #Texas going to secede already?

They've threatened it for yrs & yrs.

Do it & be done w/it.

Not a willing partner in the union, don't honor the #Constitution or laws - ta-ta!

#NASA & #DoD: remove your assets in #TX & spread your wealth elsewhere.

We don't have to have their oil, 60% of our oil is produced & refined in other states + it'd speed up transition to renewables.

Sick of the melodrama. Give em the border all to themselves.

Good riddance.

@Teri_Kanefield I remember when Roe was overturned the same types were saying we should all respect the law.

Rule of law for thee but not for me.

Freedom and liberty for me but not for thee.

@Teri_Kanefield Yeah... and the political establishment wasn't *all that mad* at what he did.

In fact, they agreed!

Not sure they care enough about the boarder (as currently constructed) one way or the other in this case... 🤔

@Teri_Kanefield Yup. All races can vote in Texas.

And yet, Abbott gets elected every election since 2015.

That's the uncomfortable truth about Texas constituents. They either vote for Abbott or they probably don't vote.

I'll wait for the inevitable gerrymandering fingerwagger to chime in here but the issue is recursive: Gerrymandering is possible because Texas' constituents voted for terrible legislators.

Abbott exists because Texas' votes from him. God help us all.

@Teri_Kanefield Sorry. I'm just really bitter about the Texas & Abbott horror show. He's one of the few clowns that make DeSantis look normal. Incredibly discouraging.
@Teri_Kanefield Jackson refused the court. Biden is refusing to enforce the law. Some say he's engaged in human trafficking. It's pure evil. History will not be kind to him, either.
