PEN America: Police Raid on Kansas Newspaper "Almost Certainly" Violates Federal Law

n response to the police raid on The Marion County Record newspaper in Kansas, PEN America issued the following statement: "Journalists rely on confidential sources to report on matters of vital public concern. Law enforcement's sweeping raid on The Marion County Record and confiscation of its equipment almost certainly violates federal law and puts the paper's very ability to publish the news in jeopardy. Such egregious attempts to interfere with news reporting cannot go unchecked in a democracy. Law enforcement can, and should, be held accountable for any violations of The Record's legal rights."

“A law enforcement raid of a newspaper office is deeply upsetting anywhere in the world. It is especially concerning in the United States, where we have strong and well-established legal protections guaranteeing the freedom of the press.” - Eileen O’Reilly, president of the National Press Club, and Gil Klein, president of the National Press Club Journalism Institute https://www.press.org/newsroom/press-club-leaders-condemn-raid-kansas-newspaper-local-law-enforcement
Press Club leaders condemn raid on Kansas newspaper by local law enforcement

WASHINGTON, August 12 – Following is a statement from Eileen O’Reilly, president of the National Press Club, and Gil Klein, president of the National Press Club Journalism Institute, on the reported raid of the Marion County Record offices on Friday and seizure of reporting materials by local law enforcement authorities executing a search warrant. “We are shocked and outraged by this brazen violation of press freedom by authorities in Marion County, Kansas. Local law enforcement agencies reportedly searched the offices of the Marion County Record and the home of its publisher, and seized reporting materials including computers and cell phones, injuring a reporter’s finger in the process. “We are deeply concerned that a Kansas judge issued a search warrant authorizing this search even though the federal law clearly requires authorities to use subpoenas rather than search warrants if they seek to access records of a news organization in the course of an investigation. “A law enforcement raid of a newspaper office is deeply upsetting anywhere in the world. It is especially concerning in the United States, where we have strong and well-established legal protections guaranteeing the freedom of the press. “This search violated the rights of the journalists at the Marion County Record to serve their community by gathering and reporting the news. We stand by the Marion County Record in its efforts to continue publishing despite the seizure of important reporting material and equipment. We demand local authorities return the reporting equipment to the Marion County Record immediately, and we expect a full investigation by appropriate state and federal authorities into why this search warrant was requested, authorized and executed.” Founded in 1908, the National Press Club is the world’s leading professional organization for journalists. @w7voa

An exam on the constitution for prospective law enforcement officers might help. No sign of understanding the spirit and meaning of the first amendment here.

LE gets to slap flags on uniforms like a scout's patch only _after_ getting a 90+?

Anyway, as it stands now LE is clearly not up to speeed. Servicing the needs of an individual at the expense of the press and the greater good of the public is squarely on the target of what freedom of the press is supposed to address.

@w7voa @BBCWorld
Thanks for posting it early.

@w7voa @BBCWorld As well it should. Republicans are trying to turn the US into something that looks more like Russia, and small towns are a soft target.

@w7voa @BBCWorld

Fascist movements tend to do that.

Taking the equipment of a newspaper, then triggering the death of an elderly newspaper owner, is very Nazi.

Especially when the goal was to cover the alleged crimes of a police chief and other well-connected members of the community.

@w7voa If these cops violated the law, will they be charged with a crime?
@w7voa “It does violate the Privacy Protection Act, 42 USC § 2000aa, designed to prevent executing warrants for evidence from the media.” Orin Kerr, Berkeley Law
@w7voa thanks for staying on this story.
@w7voa Seth Stern, advocacy director at Freedom of the Press Foundation, makes the defining point about the illegality of this search: “You can’t say, ‘I’m allowed to raid the newsroom because I’m investigating a crime,’ if the crime you’re investigating is journalism,” he added.
@w7voa These actions violate our democracy and need to be investigated quickly.
@w7voa is this what constitutes a “shithole country”?
@w7voa By virtue of the illegal warrant and raid: the law enforcement who requested the illegal search warrant, the judge who signed off on it, and those that executed the warrant have now committed Involuntary manslaughter.
@w7voa this is criminal. They never should have raided the paper at all but damn them for this.
@w7voa
This is such a depressing story from a country that supposedly loves the free press.
@Forbestonow @w7voa it doesn't. It loves the *idea* of it, but in practical terms, only as an adjunct to suit it's political tribalism. As an absolute, it hates the idea of transparency and actual investigative journalism.
@[email protected]
This tragedy just to cover up some doubtless banal/ugly misdeeds, amongst crony officials, has revealed the of late rash of(like DeSantis)frighteningly partisan/personal exploitation of law enforcement. Has someone questioned the representative, whose public meeting the journalist was kicked out of?
@w7voa FYI, I was able to bypass the paywall with 1ft.io

@w7voa

the kkkoup continues ...

@w7voa MAGA voting area rule. Sign of things to come if Trump n REPUGS get into power.
@w7voa unless they just solved a serial killing, none of those cops should see freedom again.
@w7voa the only way to stop these Nazi tactics is to sue the perpetrators for their net worth. the only thing these folks understand better than hate is money.
@w7voa this makes way more sense now.

@w7voa

Way to "keep it quiet", Chief: do something ill-advised and make it to the national news cycle! Wait 'til @ProPublica or some other big investigative outlet gets hold of it. That will make things a lot more fun and interesting.

@w7voa Per Marisa Kabas on Bluesky, Meyer’s 98-year-old mother (whose home was searched) has now died.

@w7voa

The Record never printed the allegations of sexual misconduct from coworkers in his previous job against the Police Chief – on this current job for only 2 months – b/c they cldn't get anyone to go on the record, but "the allegations—including the identities of who made the allegations—were on one of the computers that got seized." #Marion #Kansas

@w7voa yokes. That’s fascism.
@w7voa “An attack on a newspaper office through an illegal search is not just an infringement on the rights of journalists but an assault on the very foundation of democracy and the public’s right to know,” Bradbury said. “This cannot be allowed to stand.” YES!
@w7voa welp. Sounds like federal marshals need to raid the police station and the judge and the restaurant owner and seize all records and communication devices. We need faster turnaround on a case that is obstruction of first amendment rights to cover up public corruption.
@w7voa Shocking assault on the press.
@w7voa and now hopefully this group of law enforcement officers learn that this will do nothing but shine more light on them
@w7voa Try running a newspaper in a small town
@w7voa disgusting behavior. I imagine they’ll come to regret it.
@w7voa @Paulatics I totally read that as "Police raid #Kanata newspaper." As if police would raid a Canadian newspaper in #Ottawa. #ottnews @dangillmor @MichaelPorter @peterdeppisch
@ap236 @w7voa @Paulatics @dangillmor We’re not there, yet, fingers crossed.

@MichaelPorter @ap236 @w7voa @Paulatics @dangillmor

But not to far away and if Trump gets elected we will be. 🥴

@w7voa So much for that 1st Amendment then. Who will they come for next?
@w7voa press or not, I read the article 3 times and I'm not sure what exactly they did that was illegal?
Someone told them that a restaurant owner had a DUI and continued to drive, they told the police, then they were raided by the police. Wtaf?
@w7voa unbelievable that duh chief thought a media pro would be silenced by taking his equipment away.
@w7voa #JoanMeyer, the 98-yo mother of the publisher of the Marion, Kansas newspaper that police raided along with her home has died. 😭💔#MarionCountyRecord
@w7voa EEF will have a fun day with these clowns.

@w7voa So where's the backstory on this? Obviously they pissed someone powerful off, but who and why? Name and shame (and sue.)

The cops are way too eager to send a SWAT team where a polite knock would do.

@w7voa I heard their publication is going ahead. Do you know when this article on police will be out?
@w7voa Answering my own question: Tuesday
I hope other journalists/newspapers are helping them get their paper out.
