I think one of the least competent #SCOTUS ever was the Justice Samuel case: it basically guts the Constitutional prohibition against *ex post facto* (retroactive) law. Per Samuel, the prohibition only applies to criminal law.
That is how you get civil laws that violate the plain and inescapable meaning of *ex post facto*. Sometimes worse, you get regulatory agencies that change their minds *overnight* and begin enforcing their edicts with even less warning than this.
