@maxkennerly It's easy to imagine a scenario where a payment to a spouse could have been legally defined as a payment to the official via indirect means and thereby illicit. We don't have that and it would seem to offend our notions of fairness (possibly even gender equity) but it's an open and obvious legal loophole. One can imagine another country with a functioning political system making this obvious tweek.

18 U.S.C § 208 is the general conflict of interest code, and it requires the executive branch (aka all federal agencies) to count spouse's financial interests. However the supreme court operates entirely outside of ethics or conflict of interest codes, which is the actual issue.
