@flexghost These universities and any other institutions that violate HIPAA are risking very serious consequences: the loss of all federal funding for research. That is the penalty. Will it be imposed? I hope so because HIPAA is one of the few ways we have to protect our private information.

P.S. I’ve had more than one run in with University of Florida on their flagrant disregard of their obligations under HIPAA.

@meltedcheese @flexghost Not HIPAA violation, but FERPA violation. Family Educational Rights and Privacy Act of 1974 protects students’ school and medical records. The Civil Rights Division of the Department of Education should be investigating DeSantis and any Florida school administrators and government officials involved in illegally accessing students’ records. Further, trans students should have 504 protections under IDEA.

@flexghost …looks like the “request” is carefully dancing around hipaa - not names but counts of students receiving treatment, # of treatments provided, etc. No less fucked up and better get challenged. But expect them to argue that the state collects similar stats on other diagnoses - covid, flu, cancer and others get reported. They’ll say “what’s the difference? We already get counts of covid diagnoses, we just want the same information on number of gender dysphoria diagnoses.”

According to the law they have to be able to assure that the risk is very small that the person can be identified, or break the data into units no smaller than state level. Given the small number of trans individuals on any campus, seems like a lawyer could argue that the risk of identification is high, but then again, I am not an attorney.

@flexghost Exactly what "medical records" would any university have on any student other than standard normally requested medical inform such as immunizations which more point in time health information than a medical record. And how would any university know which records are trans. The only way any university could comply to a medical records request is if they have provided medical services. Which would very much be HIPAA covered. What units/areas of these 6 university provide what kind of medical records? This a BS request.

@flexghost Even if these students have student health care, the universities would not/should not have any student’s medical record. They would be maintaining by the healthcare provider or student heathplan administrator. How in the hell did these six universities comply.

That's it in a nutshell.
The mentality is like that of Alabama and Auburn football fans. Rabid tribalism. Our school can pay players, recruit with hookers, you name it. If yours does you should burn in hell. Most never attended college, probably cheated to get thru high school, if they even did.
Same with other ethnicities, other religions. AIDS epidemic was "their" problem. So now trans people are the latest fair game.
