Jason Kander:

Classified #documents - a shopping analogy:

As #Biden walked out, the buzzer went off and he realized he mistakenly failed to pay for an item in his cart. He went back in and returned it.

#Trump stuffed items in his pockets. When the buzzer sounded, he ran to his car and peeled out.

2/ Emptywheel, in part:

We don't have evidence that Biden ACCESSED the docs after they were stored. We have that with Trump.

And we still suspect there are outstanding docs in Trump's possession, or worse.

@GottaLaff
‘I wasn’t even in that store, it’s a stupid store, but even if I was, so what? Doesn’t everybody shoplift?’ 😵‍💫
@GottaLaff
Then trump led police on a year long+ chase. After being caught he declared the stolen items actually belonged to him bc he wanted them.
@GottaLaff
#Trump stuffed items in his pockets. When the buzzer sounded, he ran to his car and peeled out, and sold them to the highest bidder!
@GottaLaff No. Someone behind Biden handling the shopping cart didn’t scan properly. This is a big problem for DOJ attorneys and what will be straight to trial by jurors of peers. This clouds the potential pool even more. This is not an easy case, nor are any of them. Not cause evidence isn’t clear to US, but jury instructions and some dude who is simply one of those “contrarian” on principle types, can gum up all these troubles and possible prosecutions.#politics
@jmsjms @GottaLaff what??? A big problem how?
@MaggyW @GottaLaff because if I’m a $600 hour defense attorney the first things I’m doing:
1. Requesting motion to dismiss. Which mixes the public among two “classified” document “cases.”
2. At jury selection, I’m including within the questionnaire a) aware of President Biden.
That’s how
@jmsjms @GottaLaff no wrong doing has been identified yet.
@MaggyW He's replying to a tweet by Jason Kander that I posted, which is simply a Trump vs Biden comparison on the docs. I don't know what he's saying, exactly. @jmsjms
@GottaLaff @MaggyW I’ll make it even more clear. None of the criminal investigations will result in plea agreements. Zero.
The attorneys representing the accused will use dozens of hearings to establish jury pool questionnaires and then of course be included in striking or keeping particular jurors. A sitting president making an honest mistake vs dark of night hiding is NOT going to be the defense argument but can influence an average “Joe” and impact jury instructions.
@GottaLaff Except that it wasn't even Biden doing the shopping.
@GottaLaff When the cops got to his house, he claimed that he'd marked them all as free, in his mind, and not told anyone.
@GottaLaff trump sucks, but this is a bad analogy because stealing from corporations is based

@GottaLaff Pretty good analogy. My experience working in a TS/SCI/TK/B environment may also help. Has a highly classified printout on my desk. Left the room for potty break. The door to the room has no security features. Someone came into my room and placed the printout in my briefcase. For some reason, I checked my briefcase before I left for home and almost had a COW! Just because that room was my office did not mean that someone else could not get in.

At least the location of the documents found in the Biden search were in facilities that probably had government permission to hold classified documents. The documents were probably also not stored in cardboard boxes.

@GottaLaff
True.

Biden tried to repair his slipup, returning the documents to their proper owner: The National Archives.

Trump discreetly stole boxloads of documents, which confutes the argument that he "didn't intend to steal them."
Afterwards, the FBI had to raid his resort to retrieve them.

See the difference? 'Cause I am.

@south_lib And lied about them. And ignored the authorities. And said he owned them.

Biden voluntarily returned them, didn't know about them, and whoever slipped up will likely be fired.

@GottaLaff Not a bad analogy, but classified documents are not cans of peas.
@GottaLaff Oh, pleez, I’m trying to get your analogy, but can’t get past the thought of trump running anywhere…
