Well ACTUALLY Twitter accounts that use public records to track airplane movements are a historically recognized EXCEPTION to the First Amendment, if you actually cared about free speech you'd know that.
@Popehat Seems like he arbitrarily ignores vs. cites whatever is most convenient to him doing and saying whatever he wants
@Popehat The Founding Fathers were very strict about this.
@mok0 @Popehat Yes, of course they were. It was exactly this sort of intel that enabled General Washington to seize the airports at Valley Forge.
@Popehat Personally, I'll claim "IANAL" on that one.
@Popehat it's genuinely amusing that you're being forced to troll yourself in the absence of a strong shitlord presence here
@terminalmage @Popehat I had to read it three times thank you lol
@Popehat Of course that makes sense. An originalist reading of the First Amendment shows that there was zero mention of flight data, thus no free speech violation. If the Founders thought over-the-air radio broadcasts were protected, they would have written about them.
@Popehat After the Revolutionary War, the founders realized the air force needed to be deregulated to protect it from government overreach.
They also required air traffic controllers to be prohibited from forming unions.
@Popehat
The only beings lower than Musk are the lickspittles who cling to his ankles and hiss at anyone who dares suggest he's inconsistent or hypocritical.

@angiebaby @Popehat This is great. I think I read it five times for the visual.

It’s like savoring Hemingway.

@angiebaby @Popehat Following you for
πŸ†Best Language Use During an InsultπŸ†, an award for which there is stiff competition.
@Popehat Is this the part where we call you a groomer and stuff or is that passΓ© already?
@WhereDoesThisButtonGo I believe this is the part where we scream about all these people having pronouns to our son X Γ† A-12.
@Popehat As Justice Holmes famously said, β€œdelete your account, sir. Take the L.”
β€œJust here for the ratio,” said Justice White, concurring.

@Popehat what is HILARIOUS is this: The also tried to block the URL to the IG account of the tracker. But the standard short URLs or even passing BOGUS ARGUMENTs to the same URL worked fine.

Someone did exactly what the boss asked for an not one bit more.

@Popehat you can't shout RICO in a crowded airplane

@Popehat

#Twitter is no longer a social media channel.

It is an expensive toy of a filthy rich prat. You can play with it if you obey the rules of the owner.

@reinoudk @Popehat Rules which change on a waft of whim, but alas, on never even a wisp of whimsy.
@Popehat People who want actions to be consistent with pronouncements and policies to be implemented impartially are boring and don't see the thrill that comes from trying to please a capricious, petty, and paranoid tech overlord.
@Popehat the founding fathers both understood the concepts of social media, air travel, transponders, and billionaires and enumerated their impact on all of the amendments. Dummy.

@Popehat What about Mastodon accounts? /s

(in all due seriousness, I've got an itch to make a 4th mastodon bot after having seen that news).

@Popehat I've very interested in less online tracking of Elon's mouth movements.

@Popehat

The young man has already set himself up here on Mastadon.

@Popehat
As a software engineer, I request you STAY IN YOUR LANE and stop stating stupid legal beliefs. That is OUR lane, thankyouverymuch.
@eagerpebble @Popehat I love your optimism, in a world where we can’t even get people driving CARS to stay in their lanes. You are clearly living your best life.

@Popehat

Did the Founders have any sites tracking airplane movements? No. Q.E.D.

@Popehat Kicking out an essential part of the OSINT community is a great way to start losing important power-users. Elon, praise be upon him, is doing his best to kill the hellsite.
@Popehat On a slightly more serious note, it's amazing how unstable he's become.
@Popehat that’s Amendment XXVIII, right?
@bascule @Popehat XXVIII section 22 paragraph b. Clear as day. A really muggy, overcast, foggy day.
@Popehat WELL ACTUALLY the Founding Father's intended all along for there to be a carve-out in the 1st Amendment to protect billionaires' feelings. 🀣
@Popehat sounds like a RICO to me. Someone’s got to be held accountable for the release of that public information!
@Popehat imma bout to sue my con law profs for malpractice
@Popehat most don’t have how the 1st amendment works
@Popehat Look, everyone knows you can't out flier via avowed tweeter.
@Popehat
Ah, yes, the widely recognized "Fire in a crowded hangar" exception.

@Popehat

Yes, any free speech absolutist knows this. πŸ€·β€β™‚οΈ

Ken Paxton Tried to Get List of Transgender Texans

The office of Ken Paxton’s request speaks to the increasing scrutiny and targeting of transgender individuals by GOP lawmakers

Rolling Stone
He is so bad at this. If he didn’t want people paying attention to where his plan was, he just put an AirTag on it and then write a bot to ping the location every 10 minutes. @Popehat
@Popehat As we know the Kanye West test has superceded the Brandenburg test. The question the Ye test asks is: "Does this speech make Elon Musk angry enough to punch someone?" If the answer is "Yes" then it's unprotected speech.

@Popehat Hey Popehat, was surprised but not surprised to see your departure from Twitter. Nice to see you here. I've been a regular since the days when Groklaw closed and used to read your popehat.com blog.

Question: Do you ever think you'll go back to writing on your website again?

Cheers

@Popehat

Didn’t take first amendment, but I can appreciate some legal sarcasm… but I would be careful as some people may not realize you are riffing Dr. Jonathan Swift /Stephen Colbert.

Happy we have lawyers making the switch.

@Popehat Anyone has the website URL? Musk could ban the account but I bet the website is still online?
@ingenomada @Popehat Even better, the account moved over here!

@Popehat

I'm mad at the universe I know what this is about without looking it up.

@Popehat "historically"? I don't think Twitter has been around long enough for there to a historic standard.
@Popehat Musk hasn't thought out all the details...
@Popehat Do you have case law to shows this?
@Popehat still no exception to being triggered or a snowflake
@Popehat Elon's now making legal threats towards @JxckS - duuno how the Popehat-signal works in mastodon land, but figured I'd try to signal-boost.
@Popehat Musk is almost as ignorant as Trump.
@Popehat I know it regulated in airports and inside aircraft, I didn't know telling some you know where a plane was also regulated. Your citation to the law is what convinced me.
