Your Excellency,
You are currently in a unique position to raise awareness and change the destiny of the human race. I sincerely hope you will take the time to read this message and understand what I am trying to say.
The human race is facing an existential threat caused by overpopulation, global warming, climate change, political/religious conflict, imperialism, war, and the failure of the United Nations to achieve its primary mandate of maintaining international peace and security. If we are going to survive we must change and we must solve the problems which we ourselves have created.
The primary reason for the failure of the United Nations to maintain international peace is noncompliance with the United Nations Charter as written and our failure to raise awareness of those charter violations. I believe there are two articles that are the most problematic
The clause defining permanent membership in the Security Council, UN Charter Article 23 Paragraph 1, has not been amended and as written, The Peoples Republic of China and the Russian Federation are not permanent members of the Security Council. Article 23 Paragraph 1 states: The Security Council shall consist of fifteen Members of the United Nations. The Republic of China, France, the Union of Soviet Socialist Republics, the United Kingdom of Great Britain and Northern Ireland, and the United States of America shall be permanent members of the Security Council. The Russian Federation and the People’s Republic of China are not mentioned in Article 27, are not members of the security council, and have no right to vote on Security Council matters.
Article 27 Paragraph 3 provides an exception to the Unanimous Consent rule. Article 27 paragraph 3 reads: Decisions of the Security Council on all other matters shall be made by an affirmative vote of nine members including the concurring votes of the permanent members; provided that, in decisions under Chapter VI, and under paragraph 3 of Article 52, a party to a dispute shall abstain from voting. The United States, Great Britain, and France aare the only valid permanent members of the Security Council. They are all parties to the dispute in Ukraine and all must abstain. The United States and Great Britain have been parties to the dispute between Israel and its neighbors since the 1920 yet the United States has refused to abstain in over 60 Security Council votes on those conflicts. Would there be a Ukraine War today if the Russian Federation was not allowed to veto Security Council resolutions on that conflict. How many wars and armed conflicts could have been avoided if the United States had not been allowed to veto those Security Council Resolutions pertaining to Israel’s years of segregation, genocide, and ethnic cleansing. Those vetoes simply encourage War Crimes and Crimes Against Humanity.
You are in a position to work with the members of the General Assembly to raise public awareness of these two articles. The General Assembly can request an advisory opinion from the International Court of Justice at any time. It is time for the General Assembly to discuss these two Articles and to request and Advisory Opinion from the ICJ. What is the courts opinion on Article 23 Paragraph 1 as to the status of the Russian Federation and the Peoples Republic of China on the Security Council? What is the courts opinion on Article 27 Paragraph 3 and what does it mean? It only makes sense if it is an exception to the Unanimous Consent Rule and is directed at the permanent members of the Security Council
Until it is amended the charter needs to be enforced as written, it does give us a wide range of options Article 5, suspension of all rights and privileges. Article 6, expulsion from the United Nations. Article 41 and Article 42, a full air, sea, and land blockade. Articles 43 through 51, war. . It is time for the United Nations to achieve its primary mandate of maintaining international peace and security.
