The NRTA and the Saskatchewan First Act have the FSIN in the province threatening legal action.

The time for action against both Acts is now, say chiefs.

There was no consultation of the NRTA when the legislation put control of natural resources into the hands of the western provinces in 1930, and there was no consultation when the Sask. First Act asserted exclusive jurisdiction over resources in 2022.

Saskatchewan First Nations to strike back at Sask. First Act, NRTA with legal action

The Federation of Sovereign Indigenous Nations (FSIN) has put the governments of Saskatchewan and Canada on notice. In the next two weeks the organization plans to file a statement of claim in court to challenge the governments’ control over natural resources. “A battle is brewing,” said FSIN Chief Bobby Cameron at a press conference on Aug. 29, and legal action has been a long time in coming. “Since treaties were signed, they have been impacted. They have been infringed on. They have been breached,” he said.

The 1930 Natural Resources Transfer Act was again on the assembly floor as chiefs with the Assembly of First Nations continue to push Canada to rescind the "discriminatory legislation" which breaches the treaty and constitutional rights of First Nations, they assert.

This issue, and Specific Claims reform, was part of a series of land back resolutions dealt with at the AFN annual general assembly on July 13.

Chiefs continue to press feds on its land back and NRTA shortcomings

Reforms are needed in broken systems that are cumbersome to navigate and too slow to be realized when it comes to land back, said chiefs at last week’s annual general assembly for the Assembly of First Nations (AFN) in Halifax. Resolutions adopted in that assembly focused on the federal government working with First Nations to reform the Additions to Reserve land process and to develop a framework for a Specific Claims process that recognizes Indigenous laws, legal orders and systems of land tenure.

Last week, at the Assembly of First Nations special chiefs assembly, Justice Minister David Lametti agreed to look at the NRTA at the behest of the chiefs, some asking that the agreement be rescinded.

The premiers of the provinces of Alberta, Saskatchewan and Manitoba expressed outrage at the thought. Woodhouse gives the First Nations perspective on the agreements.

I applaud Minister (David) Lametti’s acknowledgement there are issues to review on how the Natural Resources Transfer Agreement (NRTA) does not align with Treaty or International Human Rights standards and how that impacts First Nations. Frankly, this discussion is long overdue, and First Nations have been preparing for this discussion for decades. The Natural Resources Transfer Act is a violation of Treaty and is not compliant with our inherent and Treaty rights.
