#israel / International law experts call Israeli media to stop platforming genocidal voices and deceive the public about the legality of the actions of IDF in Gaza
A group of academics, law professors teaching international law and laws of war at law schools in Israel, appealed today (Jan 24) to the chief editors of the major Israeli broadcast channels, asking them to challenge interviewees who express support for acts that violate international law, with an emphasis on starving the residents of the Strip.
“The most important rule in the laws of warfare is the duty of parties to distinguish between fighters and civilians,” the signatories on the letter state, reminding that whether civilians support Hamas or not, “civilians lose their protection as civilians only to the extent, and for the time, that they directly participate in hostilities.”
The letter also states that:
International law "imposes an absolute prohibition on using starvation of civilians as a method of warfare." Therefore, "proposals to prevent the supply of food and water to the civilian population in Gaza in order to pressure Hamas stand in violation of international law, and their implementation may incur international criminal responsibility for those carrying them out."
According to international law, even when besieging enemy forces one must ensure civilian suffering from the siege is avoided. A siege of enemy fighters that causes "incidental civilian damage that is excessive" ceases to be legal. Opening an escape route from the besieged area "does not legitimize the use of this measure," if the purpose of the siege is to starve civilians.
