LilMikeSF#ICYMI In a 94-page opinion yesterday, a 4-1 majority #Pennsylvania #CourtDecision has ruled that counties cannot simply toss out any mail-in #ballots due to missing , hard to read or incorrect #handwritten dates on their outer return envelopes.
Enforcement of previous #RNC endorsed requirement violated the state constitution’s Free and #EqualElections Clause and resulted in the erroneously directed #disqualification of over 10,000 mail-in ballots statewide alone during the 2022 midterm elections.
The #DNC filed in support of the challenge that was originally brought by the #BlackPoliticalEmpowermentProject who also had a federal case claiming the law contravened a provision of the #CivilRightsAct but that case was stopped in the #ThirdCircuit. #RepublicanParty operatives vowed to take it to PA's #SupremeCourt within 72 hour limit to file a legal challenge.
