Tony Earls Jr., 33, is accused of firing multiple gunshots into a pickup truck Alvarez was riding in after he had been robbed at a southeast Houston bank. Earls was arrested and charged with aggravated assault in the immediate aftermath of the shooting but subsequently no-billed by a grand jury. Another grand jury indicted him on a murder charge this week, based on new evidence.

Prosecutors reexamining case of 9-year-old Arlene Alvarez, who was shot in 2022
Arlene was killed in 2022 when Tony Earls was being robbed at an ATM in southeast Houston. Earls fired toward the robber, and a bullet instead struck the girl while she was in a vehicle driving by the scene.
