@annmlipton It's worse than that. The most recent S-1 (https://www.sec.gov/Archives/edgar/data/1849635/000114036124032424/ny20031506x1_s1.htm) says that he may make any post that he deems politically related *in his sole discretion* on any social media site at any time. That is, anything that Trump says is political is exempt from the exclusivity. Given Trump is gonna Trump, the promise is nearly illusory.

@chrisgeidner I think he doesn't have jurisdiction to do this now (in 5th, but not other circuit). This is on all fours with *In re Fort Worth Chamber of Commerce*, 100 F.4th 528 (5th Cir. 2024). I think *Fort Worth* is wrong and its reasoning implicitly rejects the holding of *Lou v. Belsberg*, 834 F.2d 720, 733 (9th Cir. 1984), that "[o]nce jurisdiction is properly obtained by the appellate court it is not terminated by the subsequent completion of a section 1404 transfer," but it's the 5th.
