The rule makes no mention of Mexico actually agreeing to take back denied asylum seekers. Just a "willingness" as long as the US maintains alternative pathways (like the current humanitarian parole program).

Here's how the proposed "transit ban" rule would define an asylum seeker's "rebuttable presumption of ineligibility."

The rule would go into effect once the Title 42 policy terminates, and remain in effect for 2 years, though it could be prolonged.
