Reactionaries won’t stop because of an epiphany they shouldn’t go *that* far. They will either *be stopped* - or install a system in which only they and those who reflect their image back at them are entitled to rule and recognized as equal.
I tried to synthesize my thoughts on all of this a while back: https://thomaszimmer.substack.com/p/one-year-on-from-dobbs-the-dangers
Re: Jack Smith's motion for a protective order limiting Trump's efforts to influence the jury pool, including by "polling" potential jurors:
About a hundred years ago I used to work for a big law firm that represented a major aerospace contractor being investigated by a grand jury for possible procurement fraud.
My boss told our client, as a throwaway thought at the end of a long strategy discussion, to think about maybe buying some TV ads about how their company and its cool, high-tech new military aircraft were keeping our country safe.
After about a week, I saw exactly that ad nearly every time I turned on the teevee. Zoom! Military aircraft! Noble music! American flags! For weeks. Over and over and over. Millions and millions of dollars, hoping to catch just one or two grand jurors' eyes, in the longest of long shot gambles that it might have some impact.
Now imaging the "potential juror" push-polling Trump and his backers would do in D.C. absent a restraining order.
Often in life, two good principles come into conflict. Friends sharing wine is good! And laws against drunk driving are good! So we compromise – we balance the two interests – by setting a blood alcohol limit that serves both interests while fully indulging neither of them.
Free speech is good. Fair trials are good. Proper protective orders like the one Jack Smith is seeking today, allowing criminal defendant Trump to proclaim his innocence but without prejudicing jurors and witnesses, is just such a compromise, protecting both interests while fully indulging neither. But conservatives like Trump can't tolerate the cognitive dissonance inherent in such compromises.
And so comes another opportunity for CJ Roberts to show some integrity and exert some leadership by pressuring Alito to recuse, as a belated step toward imposing an externally enforced code of ethics on SCOTUS.
Chances of that happening are zero.
Justice Alito rejects recusal in major tax case:
