Der Streit der Literaturzeitschriften ist entschieden: Die Akademie der Künste darf die Zeitschrift Sinn und Form zumindest zum jetzigen Zeitpunkt nicht mehr herausgeben, ansonsten droht ihr ein Ordnungsgeld von bis zu 250.000 Euro. Das Landgericht Berlin hat der Klage des Herausgebers der Kulturzeitschrift Lettre International, Frank Berberich, stattgegeben. Das war zu erwarten, nachdem der Versuch einer gütlichen Einigung gescheitert war. Überraschend ist aber die nüchterne Begründung des Gerichts, das sich allein auf das Wettbewerbsrecht fokussiert und den verfassungsrechtlichen Fragen, die der Fall aufwirft, aus dem Weg geht. Diese Fragen sind in der Tat nicht leicht zu beantworten.

Nein, "aus Sicht der maßgeblichen Verkehrskreise" sind die "Erzeugnisse" Sinn und Form und Lettre International NICHT "austauschbar". Die Anzeigen, von denen die Lettre lebt, stammen nicht selten von Staatsopern und staatlichen Museen. Kultur ist, wenn nicht schon in der Warenform verschwunden, immer ein Gut, das der Subvention bedarf. Willkür, Bräsigkeit und Geschäftigkeit der Subventionsbürokratie stoßen bei Lettre zurecht auf. Zweifelhaft ist die Form der Kritik.

But in the grand sweep of history that is a rebalancing or restoration not a revolution. Until the 18th century, the Pacific and Indian Oceans were the heart of sophisticated economic activity. That balance was grossly distorted in the “centuries of humiliation” by the rise of the West. Now, thanks to Asian economic growth, the centers of economic activity and population are realigning.
