I cannot read the article, to discover if you answer your question, but my understanding is Canada gave ownership of the rail lines to CN Railways as a part of the privatisation in 1995.
Which, in my mind, means that yes, CN is going to make the mandated access to their rail network as unpleasant, random, and expensive as they possibly can.
It is only *not* inevitable if Canada charges them for violating the contractual requirement, or nationalizes the property because of it.
