Anyone who’s been paying attention would have seen Gorsuch’s question coming and prepared accordingly.
@georgetakei honestly, he should've had an answer to this one off the cuff. it's kind of an important historical detail of the sort that one would expect a supreme court justice to be familiar with the precedent of

(and it is more complicated than yes or no, since there was a clause put in specifically to frustrate this answer)
