They've worded it so that it leaves everything open for them to do this in future.

If they don't make an explicit legal promise that they will never do this under threat of financial penalties, then they're planning on doing it again when no-one notices.

It's the same MO that they have always used.

Note that they also scan emails to build up a profile of you for marketing purposes too, information that is included in your Google takeout.
