General, Maja

We have received worrying news from the Hungarian prison hospital, which we cannot further verify or specify.

Today, July 5, 2025, Maja reported in a telephone conversation with her family about the assessment of the doctors at the prison hospital where Maja is currently being held and cared for:

Maja now weighs only 65 kg and has lost about 13 kg.
The liver and kidneys are no longer in the best condition.
There are reduced levels of iron, phosphorus, vitamin K (important for blood clotting) and hormones.
The bilirubin level (a pigment from the breakdown of red blood pigment, which is excreted via the liver/gall bladder) is elevated.
There is water retention in the foot.
Eye twitching was observed.

The treating physicians also stated that they do not feel bound by Maja's advance directive or by Maja's refusal of involuntary treatment. They would act if Maja's condition worsened, regardless of Maja's stated wishes.

This attitude clearly contradicts the ethical guidelines clearly formulated by the World Medical Association in the Malta Declaration. Furthermore, forced treatment against a patient's will would constitute a criminal offense in Germany.

We therefore call again and with great urgency:

Maja must be able to speak confidentially, i.e., face-to-face, with an independent doctor in German or with the assistance of an interpreter, and be examined by them. This is important so that Maja can correctly understand and classify the findings.
The Foreign Office must intervene immediately, not only through the embassy but also at the highest level.

A tragedy is looming that can still be prevented. This doesn't require special rights or privileges, but rather adherence to internationally valid rules, formally signed by Hungary, as well as respect for fundamental and human rights. And it needs a foreign minister who will finally actively defend the constitutional principles of Germany and Europe, and thus Maja's dignity.

More Informations

-According to recent reports, anti-fascist Maja, who was illegally extradited to Hungary over a year ago and has been subjected to regular torture ever since, has now been transferred to a prison hospital due to her hunger strike. This is the 32nd day of the hunger strike. According to supporters, eye movement disorders have now been observed, suggesting that she has entered the "ocular phase" of the hunger strike (more details on the hunger phases can be found in our post from June 25). This suggests that Maja has reached an acutely life-threatening condition.

According to reports, doctors at the Hungarian prison hospital stated that they do not feel bound by Maja's advance directive, which explicitly excludes forced feeding. We would like to put this into context below:

Force-feeding occurs repeatedly around the world, especially among prisoners on hunger strike. This deprives prisoners, who already have very limited options for protest, of their last means of protest, for example, against prison conditions, and of control over their own bodies.

Medicine worldwide has a clear principle of decision-making called "informed consent." Doctors do not make the decision themselves; instead, they inform their patients about all the options and risks so that they can make an informed decision about their own bodies. Of course, this has its limits, for example when a person is unconscious. In this case, the person's presumed wishes must be followed. Living wills, authorized representatives, and relatives can all help determine this. There are also exceptions for situations in which patients are no longer able to make decisions for themselves due to their cognitive state, or where there are other risks, such as mental illness or in the case of children. A further limitation is that, of course, no doctor is forced to carry out medically pointless measures just because a patient absolutely wishes it.

This principle must also be fully applied during a hunger strike, so that the person on hunger strike can make their own decisions about their body. In order to ensure that legally sound documentation of the hunger striker's wishes is available in all eventualities, we recommend, if possible, contacting medical professionals who are in solidarity and who can supervise the hunger strike as early as possible.

Forced treatment, especially forced feeding, of hunger strikers is thus fundamentally contrary to the basic principle of "informed consent" and contradicts the rules of medical practice. The fact that it continues to occur with medical involvement to this day has prompted the World Medical Association (WMA) to issue several clear statements prohibiting all doctors worldwide from forcing forced treatment of hunger strikers. After the Tokyo Declaration of 1975 prohibited doctors from any involvement in torture and humiliation, which the WMA clearly includes forced feeding, the Malta Declaration of 1991 established detailed regulations for the medical treatment of hunger strikers, which have been repeatedly revised and tightened due to persistent, prohibited forced feeding. The current version states, among other things:
“All kinds of interventions for enteral or parenteral feeding against the will of the mentally competent hunger striker are “to be considered as “forced feeding”. Forced feeding is never ethically acceptable. Even if intended to benefit, feeding accompanied by threats, coercion, force or use of physical restraints is a form of inhuman and degrading treatment. Equally unacceptable is the forced feeding of some detainees in order to intimidate or coerce other hunger strikers to stop fasting.”

The World Medical Association consists of 115 professional associations of physicians around the world. Its declarations are binding for its members and the physicians in their respective countries. For Germany, the German Medical Association is a member of the WMA, as is the Hungarian Medical Association (Magyar Orvosi Kamara). However, unlike the German Medical Association, the latter has limited powers and influence. Doctors' self-government with disciplinary powers, as exists in Germany, does not exist in Hungary. This makes it easier for authorities in Hungary to influence medical decisions and thus enforce treatments that contradict medical practice and human rights. That things can be done differently is demonstrated by a 2010 case in which a court in Switzerland ordered forced feeding during a hunger strike. At the time, the doctors in charge refused to carry out the forced feeding, citing the regulations of the Swiss medical profession, which are based on the Malta Declaration.

Update about Maja

>Maja T. loses 14 kilos – Doctors consider pacemaker

-Maja T., a nonbinary person imprisoned in Hungary, is struggling with life-threatening consequences after a four-week hunger strike, according to those close to her. Her heart rate is alarmingly low.

The health of Maja T. (24), a German non-binary person imprisoned in Budapest, is deteriorating rapidly, according to sources close to her. Maja T. – on hunger strike for four weeks – has already lost 14 kilograms, a solidarity committee for Maja's hunger strike and her father jointly announced. The treating doctors are assessing the situation as very critical and are considering implanting a pacemaker, said Maja T.'s father, Wolfram Jarosch. Her heart rate has occasionally dropped to 30 beats per minute. Fainting spells and even cardiac arrest are possible.

Maja T. is on trial in Budapest for alleged bodily harm during protests against right-wing extremists in February 2023 (queer.de reported). She faces a sentence of 24 years in prison.

Pacemaker would not be a solution

Due to her health condition, Maja T. had already been taken to a prison hospital. However, it was stated that a 24-hour ECG with continuous monitoring was not possible there. Transfer to a civilian hospital could be considered as an alternative. However, there, Maja T. would be confined to bed around the clock, as the same security measures as in a prison hospital are not in place.

"Under no circumstances should a pacemaker be implanted against Maja's will. This would also not be medically helpful, as her low heart rate is a direct result of the hunger strike," Jarosch explained. Furthermore, Maja T. should not be confined to her bed, as this would be cruel and medically unnecessary.

The father demanded that the Foreign Office urgently seek an end to Maja's solitary confinement and her return to Germany. He assumed that Maja would want to continue her hunger strike because of the solitary confinement.

Illegally deported from Germany

German politicians from the Green Party and the Left Party are demanding her return to Germany. Maja T. was arrested in Berlin in December 2023 and extradited to Hungary in June 2024 – despite the Federal Constitutional Court's prohibition. But the decision from Karlsruhe came a few minutes too late (queer.de reported). Most recently, the court in Budapest rejected a request for her transfer to house arrest.

In light of her deteriorating health, the SPD in the Bundestag called for intervention by Foreign Minister Johann Wadephul (CDU). "Mr. Wadephul must bring Maja T. back home," said Falko Droßmann, the SPD parliamentary group's spokesperson for queer policy, to the "taz" newspaper. "We expect the Federal Foreign Office to finally ensure that our ambassador to Hungary personally contacts Maja T. and that our Foreign Minister does everything possible to comply with the demands of the Federal Constitutional Court," Droßmann said.

The Association of Democratic Doctors called on its treating colleagues in Hungary to respect Maja T.'s dignity and will. Christian Bachelier, a member of the association's board, called on the German government to act immediately: "It cannot be that people are extradited in secret operations and then subjected to violations of fundamental rights, such as solitary confinement, which is clearly defined as torture."

Droßmann also said: "It is the duty of the Federal Foreign Office to care for unlawfully detained Germans – actually even without a specific directive from the Federal Constitutional Court." Afterwards, Droßmann said, the matter must be comprehensively investigated. The case seriously undermines trust in the rule of law.

SPD doubts fair trial

Droßmann expressed "significant doubts" about the prison conditions and the legality of a trial in Hungary. "We stand in solidarity with Maja T. and are committed at all political levels to ensuring that Maja T.'s fundamental rights are respected."

According to the "taz" newspaper, the German Foreign Office recently stated that it would be "providing high-level support" for Maja T. T. is receiving consular assistance in Hungary, and efforts are being made to improve detention conditions and provide adequate medical care. However, Hungarian courts would have to decide on her return to Germany. According to the newspaper, the trial against T. is currently on a summer break until September. (cw/dpa)

>It gives a Reaction from German Government about Maja

>Maja T. is on trial in Hungary for an attack on right-wing extremists in Budapest. The German woman is on hunger strike in protest against her prison conditions. The German Foreign Office has now issued a statement.

The German government has expressed concern about the health of Maja T., a person imprisoned in Hungary. "The concern is, of course, great," said a spokeswoman for the Federal Foreign Office in Berlin. The German government is in "close contact" with the relatives, and the German Embassy in Budapest has been able to speak with Maja T. The conversation took place in a hospital where Maja T. is being treated for her health condition.

The non-binary German person Maja T. was arrested in Berlin in December 2023. The reason was the accusation by the Hungarian authorities that Maja T., together with other anti-fascist activists, had attacked members of the right-wing extremist scene in Budapest in February 2023. In June 2024, she was extradited to Hungary – despite ongoing expedited proceedings before the Federal Constitutional Court, which then issued an interim injunction prohibiting extradition immediately after her transfer.

-In light of Maja T.'s deteriorating health, the SPD in the Bundestag is calling for Foreign Minister Johann Wadephul to intervene. "Mr. Wadephul must bring Maja T. back home," said Falko Droßmann, the SPD parliamentary group's queer policy spokesperson, to the "taz" newspaper. A solidarity committee and the father reported that Maja T. – who has been on hunger strike for about four weeks – has already lost 14 kilograms.

With her hunger strike, Maja T. is seeking better prison conditions and a return to Germany. Hungarian doctors recently threatened to force-feed her, even though Maja T. has rejected this in her advance directive.

Due to her significantly reduced heart rate, doctors are also considering implanting a pacemaker. Alternatively, the 24-year-old could be transferred to a civilian hospital. Unlike in the prison clinic, continuous ECG monitoring would be possible there – but according to her family, T. would be confined to a bed around the clock. Maja T.'s father opposes both options.

Du das machen die hier in Deutschland auch, wenn Gefangene in ein ziviles Krankenhaus müssen. Ich hab das auf Station schon mal erlebt. Da steht dann auch Wache vor abgesperrter Tür, sicher ist sicher. 🤢
