My expectation from today's oral arguments at the #SCOTUS in Trump v. CASA is that the Court will restrict the use of universal injunctions by lower courts by providing clearer (if not entirely clear) guidance on when such injunctions will pass musterβ€”namely, when a case presents a facial challenge to the plain language of the Constitution's enumeration of a fundamental right. Below that level it's anyone guess as to what the Court will say. #USpol
I will not be surprised if the #SCOTUS also issues a binding opinion on the merits of the challenge to Amendment XIV, even though the merits were not actually the question before the Court, although my expectation is that they will issue a dicta opinion on the matter warning the government not to raise the case before the Court. #USpol #BirthrightCitizenship #JusSoli

There seems to be a strong majority of the #SCOTUS that believes that universal injunctions have proliferated to the point where we require limits on the use of them, but there seems to also be a strong majority of the Court that is itching to issue a rebuke to the Trump regime on the matter of Amendment XIV's citizenship clause.

The Court clearly decided to hear arguments on this case precisely because the EO is meritless on its face, allowing them to separate out the procedural matter. #USpol
