Also a key issue for the ICC is whether a country is capable of dealing properly with allegations of war crimes through its own judicial system. If it believes that the country is then it will just not intervene -- so it is unlikely that it would go after most of the democracies that have signed up to it. The warrant seems to be mainly based on use of starvation as a method of war which though a war crime does not amount to genocide.
