Warning: Rant coming.

The doomsaying and cynicism in my comments over the past few days are annoying me.

I am addressing the people saying any form of: "Why won't the Supreme Court rule in Trump's favor?"

You are unhinged from the facts. Get a grip.

Here are the facts: Since Trump lost in 2020, the Supreme Court, and every other court, has consistently ruled against him in his immunity claims.

If the Supreme Court wanted to install Trump as dictator, they would have helped him out in the election fraud cases when he claimed he won.

All they had to do was delay matters until after January 6, which would have thrown the country into complete turmoil.

Turmoil helps would-be dictators.

If they wanted to shield him from criminal liability, they would have said he had the right to take the secret documents.

Trump's theory of absolute criminal immunity means this:

If Trump, on his last day in office, shot someone on 5th Avenue in front of thousands of witnesses, there could be no criminal investigation until (1) The House impeached him and (2) The Senate convicted him.

If 2/3 of the Senate refused to convict him, he would walk free.

It's possible he couldn't even be impeached because impeachment, under some theories, addresses only crimes of office, and abuse of power.

Absolute criminal immunity isn't a thing. It has never been a thing. Trump made it up.

If the Supreme Court rules for him, they give up all their own power because all the President needs is enough members of Congress to refuse to impeach or remove him, and he can literally do anything.

Any crime. Anything.

If the Supreme Court does that, it's literally all over.

Incidentally, they also lose their own power. If they create a dictator they are dispensable.

The only issue going into this was whether they would give him the delays he wants.

We got the answr to that when SCOTUS responded to the DOJ's request for an expedited hearing within a few hours.

A few HOURS. Appeals can take years.

While I don't have the stats handy, I think it's safe to say that the Supreme Court rarely responds that fast.

Delay helps Trump and they know it.

Entertaining as a real possibility that SCOTUS might decide that a president can commit crimes provided he is careful about it is not a productive way to spend time.

On Sunday I was talking with a lawyer who was complaining about how all the legal commentators on Facebook (!) get him riled up, and I suggested that he look up your commentary instead. I appreciate that you do all of this as a free public service for randos like me. 💜
@Teri_Kanefield I mean, if they did, there's absolutely nothing stopping Biden from taking the steps we are worried Trump would take. That includes removing them all from office. Seems like a bad thing to vote in favor of if you like your free vacations and RVs and suchlike.

Someone tooted a while ago that if the SC ruled presidents are immune for all crimes then Biden should just shoot all the conservative SC justices, since he couldn't be arrested for it by their own ruling. Not that he would, but it would give Biden free range to do pretty much anything he wanted.

@Teri_Kanefield Although lots of people talk about 3 "Trump-appointed" judges, my sense is that they were really McConnell-appointed.
@Teri_Kanefield My relatively mild conspiracy theory is that the Justices are willing to throw Trump under the bus to give an air of legitimacy.
