THREAD As an #AfricanAmerican I am VERY skeptical about California's new #digitaldriverslicenses . To open the app and show one's DL the DL holder must input biometric data into the phone. At this point I don't know if that data is uploaded to a DMV server. I have a NUMBER of reservations about this @pluralistic @BlackAzizAnansi

3) What courts DO agree on is that police can not compell someone to reveal their PIN or password or swipepattern to unlock their device. The law considers this privileged information based on what a person KNOWS. Biometric data is not considered privileged information because it is based on who a person IS.
4) I don't carry my #driverslicense everywhere I go. After my mother was a victim of identity theft I started carrying my passport card because it is a legal ID without my address. That way if someone steals my wallet it will be harder to use my credit cards at gas stations or whererver without knowing my zip code.
5) But also when I walk or bikeride I don't bring my purse or wallet at all. I bring my "exercise" bag with my water bottle, sweat towel, ear bud case and so forth. I bring my phone but not any ID. My phone is open during my walks and rides because I use it to listen to music or talk while I walk.
6) I am very cognizant that being high melanin in the U.S. increases the likelihood that I will be subject to STOP & Frisk type over policing . I do not use biometric data on my phone because I never want to be in a position in any state or at any airport or coming back from Tijuana to be forced to open my phone.
7) The idea that I could be walking around my own city minding my business and a cop could force me to use biometric data to reveal my #digitaldriverslicenses is no less disturbing to me. For that reason while I think the tech is cool I am skeptical that I myself will use it.
8) In addition, after that 2020 #MotherBoard investigative piece showing that California DMV sells biometric data, including data used for facial recognition, to private companies, I have NO confidence about how any #biometric data I upload for the purposes of a #digitaldriverslicenses will be used . https://www.vice.com/en/article/evjekz/the-california-dmv-is-making-dollar50m-a-year-selling-drivers-personal-information
The California DMV Is Making $50M a Year Selling Drivers’ Personal Information

A document obtained by Motherboard shows how DMVs sell people’s names, addresses, and other personal information to generate revenue.

9) After the #Motherboard investigation into the California #DMV selling biometric data representatives in the California State Legislature did make moves to stop this practice. While that means something to me it does not mean enough because the information is not secure. After the 2020 report #TechNews did a report on the California DMV being hacked for that data https://techcrunch.com/2021/02/18/california-motor-vehicles-afts-ransomware/

10) With my #RealID I already had to give my fingerprint but as far as I know that biometric data is not handled by a 3rd party app contracted with DMV. What do I know about the security processes of the app contractor?
11) On the other hand -BECAUSE the DMV is insecure I could see #AfricanAmericans wanting to download the app and associate their #biometric data with their ID before a scammer using a fake ID with their name and birthday downloaded the app and used THEIR OWN biometric data to associate the #digitaldriverslicenses with themselves. The incentive to do this is high since California started demanding new licenses applicants to prove citizenship in 1994 https://www.latimes.com/archives/la-xpm-1994-03-02-mn-28981-story.html

11) My ambivalence also stems from my knowledge of how sucky the current algorithms are with processing facial recognition for high melanin people. I wrote a whole thread on this which I will link below.
12 END) I MAY end up using this app but I am certainly NOT going to be an early adopter. I am gonna see how it goes for Black people using #digitaldriverslicenses before I buy in

WHY is IRS.gov using a private 3rd party, id.me that uses a facial recognition technology KNOWN to have a problem properly identifying #BlackWomen? It's problematic in a HOST of other ways #Taxes #AI #FacialRecognition #IRS #Seniors #PoorPeople #Disabled https://photos.app.goo.gl/PPcSKgCGQYjahVYB7 @ant_pruitt @[email protected]
