Congressman, and constitutional scholar, Jamie Raskin

“Section 3 of the 14th Amendment presents a clear and unequivocal statement that anyone who has sworn an oath of office…who engage in insurrection or rebellion…can never serve again in federal or state office”

Here’s hoping the constitution still matters.

@flexghost
Could his electoral campaign be put on hold until this is resolved with many delays?
@flexghost The annoying thing is that enforcement is so easy if you are in congress. Just demand a vote to remove the disability that does not get two thirds. I can't believe the select committee didn't require that when it completed its investigation.

@flexghost Congressman, constitution scholar and two time cancer survivor—I believe this makes the man a classic badass.
@DavidNielsen that right there is a real man
@flexghost Trump’s entire career, business and political, is built on the principle of “I’m going to do whatever the hell I want, try to stop me.” This is just one more time that no one will try to stop him
@curtisysmith look how much of what trump did is still unanswered and unpunished. It works. But Democrats stick to decorum and guidelines as well as laws. It seems like shooting themselves in the foot before they start the race.
@flexghost Yes. I have no solution for this situation where one side breaks, flaunts or changes any rule they don’t like and the other side doesn’t have the political power or will to hold them accountable. The real problem is the millions of low information voters that keep electing them.

@curtisysmith @flexghost
Our inflexible governing structure doesn't help. As it is now, there can only be two viable parties at one time, since any third party only helps one of the other two parties without any real shot of holding power themselves. IOW, a third party candidate can only ever be a spoiler candidate.

This means we all must forever vote for the lesser of two evils.

@bruce @curtisysmith

Forever?

If we lose to trump there won’t be democracy. If dems win with have to deal with corporate avatars but have the chance for reform. Plus this administration, as much as I may not be pleased with them, has attempted more for expanding rights and environmental protections than all others past.

@flexghost @curtisysmith
Forever is a long time, I admit, and none of us can predict the future with any clarity. I also acknowledge the successes the Biden administration has had. But we should be realistic about the nature of our political system. Republicans will likely regain power at some point. Our job, as I see it, is to keep Democrats in power long enough that our progress cannot be easily destroyed by revanchist Republican administrations.
@flexghost @curtisysmith
Perhaps we are talking past each other. We clearly agree about the major challenges we face.
@bruce @curtisysmith agree and think to Ed Koch “if you agree with me 9/12 times..” speech

@flexghost

This is cool, but who is going to enforce it? Congress? Democrats don't have the votes and Republicans will support Trump regardless of the law.

@flexghost My question is does this require a guilty verdict first from a trial?

Also, still waiting the constitution to matter when it came to all those emoluments.

@MarcusMuench this is interesting since the special committee found that he did, in fact, attempt a coup
@flexghost Uncharted territory. My feeling is a court will need to decide what qualifies.
