Software intentionally designed to cause disruption to a computer, server, client, or computer network is malware. Being encrypted or not letting you do whatever you want with it, doesn't make it malware, just like your banking app isn't malware or your android phone isn't run by malware. And the otheway around: malware can be just as open source and "unencrypted" as anything else.
