2001: I was permanently injured by a bone screw that was only approved because the company lied to the FDA, can I sue the company?

Unanimous SCOTUS: No. Buckman, 531 US 341.

2023: Can I reverse the FDA's approval of mifepristone, a drug I will never use?

GOP Judges: Of course!

@maxkennerly “We have to reverse the approval of the drug because we cut off the ability to sue if it harms someone.”

@maxkennerly
Conservatives: citizens have the right to try experimental drugs and the fda should circumvent the process and expedite their approval

Conservatives: a 20 year old drug that has proven to be safe and has proven to be effective was rushed through without adequate vetting

@Realworldrj @maxkennerly also conservatives: the EPA should allow this company to produce a product that is virtually guaranteed to cause cancer in millions of people who don't even use the product as well as those who do https://www.propublica.org/article/chevron-epa-plastic-biofuel-cancer-risk
The EPA Faces Questions About Its Approval of a Plastic-Based Fuel With an Astronomical Cancer Risk

A senator questioned the EPA chief and a group sued the agency after ProPublica and the Guardian revealed that the EPA gave a Chevron refinery approval to make a fuel that could leave people nearby with a 1-in-4 lifetime risk of cancer.

@Realworldrj @maxkennerly Pot smokers:

Conservatives: No, not like that!

@opendna @Realworldrj @maxkennerly
Conservatives are coming around to legal weed now that they see dollar signs
@Realworldrj @maxkennerly logical consistency isn't their thing. it is always about what feels 'right' and gets the individual outcome desired
@maxkennerly Dismantling the administrative state requires lots of idiocy and hypocrisy.

@maxkennerly Yes, but you see its actually a question of standing.

While at first glance you might think that the plaintiff in the abortion case has no standing, in reality, he's a conservative and the Justices want him to so he does.

This is in contrast to the first case, where the plaintiff was an ordinary working person trying to sue a corporation for real world life-changing physical harms, which is not allowed no backsies and he has cooties.
