There is no “justice” system.

Today, Trump Org CFO Weisselberg is being sentenced to five months jail.

On a five month sentence, he'll serve approximately 100 days.

As a public defender in Manhattan, I represented a man who was sentenced to 3-6 years (and will serve 1500+ days) for stealing a jacket.

@chin @elizaorlins A recent article in The NY Times recently reported there are some 300 people responsible for tens of thousands of shoplifting crimes in that city.

Why assume shoplifting is a crime of necessity? There are GUCCI jackets that do no more to keep a person warm than a Walmart windbreaker.

My point was more information was needed before reacting with outrage.

@elizaorlins it is sad, but it is an old story. In the current context, the U.S. had two justice systems. One for wealthy, mostly white guys, and one for everyone else. There is no pretense of anything else. It only stops when the majority start saying no acting on that sentiment at the ballot box and with their economic power.

How can we have this kind of sentencing when normal people terrible sentences, and non-white gets much longer and harsher sentencing compared to these people who have defrauded millions of dollars. @elizaorlins Rich people are above the law. That's what happens when money is speech. Name one rich murderer that was sentenced to death or even life. The only time criminals get decent sentences is when the defraud the government (as long as they aren't working FOR the government.)

Fascists need heavier prison sentences. I don't condone theft (your client was deservedly jailed) but shouldn't being a fascist guarantee a much heavier prison sentence since these people are a threat to our democracy?

As others have noted, no justice for wealthy criminality. When does this change? I don't know. However, given how our legal system works, if you are wealthy, ima going to immediately assume uncaught criminality and dangerous - just by default. I think that is fair given how the poor are considered.

@elizaorlins I'm sure the jacket man could have gotten off with a lighter sentence if he or a friend was willing to spend $10M. It's interesting to imagine having the resources to outspend and wear-down the US government, make it "not worth their while".
