Asylum is legal immigration.
There's no "port of entry" requirement.
There's no "visa" requirement.
There's no "first country" requirement.
You enter the United States, and you apply for asylum.

Because asylum is legal immigration. Period.

@QasimRashid A few years ago, I started working for an organization that does important work to support refugees. Since that time, I've come to a heartbreaking understanding that so many people in my city hold utterly disgusting opinions on refugees, asylum seekers and human rights.

The fact that their opinions are based on misinformation and ignorance used to give me some hope, but no longer. Now I just alternate between sadness and anger when I consider this.

You know this, but for the readers: Since 1991, Canada provide asylum for LGBT persecution.

...but US-based claims are diminished by safe states like California, Colorado, Washington and New York. If you can get safety by moving within a country, it weakens the claim that you have to leave the country to find safety.

@mathew that's great to see the Biden admin is doing something there. Those countries are certainly not universally safe third countries.

There is another such agreement between Canada and the US. It stops #LGBTQ+ persons in the US facing systemic persrcution from accessing safety in Canada.

Thus is why my organization urges LGBTQ+ asylum seekers to avoid the US at all costs in their journey. That needs to fall too.

@QasimRashid Legally and morally you are correct. However, because of the current SCOTUS, laws and precedence seem to have little value.
In fact there is some right wing discussion that some on the court would find several amendments unconstitutional, such as the 13th, 14th, 15th and 18th. Unconstitutional constitutional amendments if you will.

@abbas @QasimRashid In case you're not just JAQing off, there are several requirements to get refugee status, but they basically boil down to fear for your life if you were to return to your home country. This could be from political persecution (such as claimed by many refugees from Cuba) or civil unrest (civil war, gang wars). There are a number of countries that the US recognizes that have these problems, which is where the majority of these refugees come from.

I’m all for immigrants coming here but there need to be some limits.

@abbas @QasimRashid nothing. Anyone can claim asylum. The process then happens to determine if they are legitimate. If they are, asylum is granted. If not, they are returned to their own country.

That's how the system is designed and has worked just fine for decades.

In Australia, if you arrive by boat, you are an illegal, never able to settle here, although we'll happily detain you at enormous cost. The government even made ads.

@QasimRashid back in the 1970’s (and later( when people were fleeing the Soviet Union to come to the USA, these folks entered similarly, except by air, at airports, or by boat. No VISAs. Seeking asylum. It was no different. (I remember, as a kid, my family helped to sponsor a couple from Bulgaria, who fled to the US…, I remember hearing the story of their escape and didn’t understand why they had to do it that way).
