I wrote a little thing about FTC consent decrees, and Twitter, and how all the people who were facing potential criminal charges for not complying with the FTC consent decree quit Twitter last night... and why Elon's not caring about the FTC doesn't much matter if the FTC cares about him... (which it likely does) https://www.techdirt.com/2022/11/10/does-twitter-have-any-employees-left-who-remember-that-the-company-is-under-a-strict-consent-decree-with-the-ftc/
Does Twitter Have Any Employees Left Who Remember That The Company Is Under A Strict Consent Decree With The FTC?

Yesterday I tweeted out a question about whether or not there was anyone left at Twitter who remembered that the company was under a pretty strict FTC consent decree: Apparently the answer was yes,…

@mmasnick very good write up thanks. Part of the reason I'm pausing my twitter usage is it doesn't seem....like a safe site. Of course this doesn't help. I hope someone does hold them accountable

@KatEmm @mmasnick Musk, who has an underserved reputation as a visionary and innovator, had no useful or creative ideas about how to breathe new life into a moribund Twittet.

To make matters worse, the impulsive changes he's made are accelerating Twitter's decline.

@mmasnick Not such a little thing. Holy crow! Thanks for this!!
@mmasnick Really interesting Mike, thank you. 👏
@mmasnick wow! Thanks for the write up. Was just hearing about the people who quit last night.
@mmasnick Does he even give a shit, though? He’ll probably just end up stalling whatever investigations and fines Twitter incurs. This country allows billionaires to do that sort of thing.
@jkohlmann there's legit criminal liability here. This isn't the SEC with wrist slapping ability. The FTC can really do damage.
@mmasnick Thanks for the answer 🙇🏼‍♂️ I am pessimistic due to how frequently the absolute worst people seem to wriggle their way out of their latest jam, but this also isn’t my area of expertise. 😩
@jkohlmann @mmasnick I came here to make the same argument. How many times have we seen all the lawsplainers speak with great certitude about how Trump or Elon or SBF (whoever is acting as if consequences are negotiable) should really fear the law this time, because this time, this time is when the consequences will finally strike down.
@micah @mmasnick I *do* get that the FTC consent decree puts Twitter at the proverbial “Strike Two”, but yeah, I expect Musk to pull some [pathetic and distracting] antics [that people will somehow fall for] at some point
@mmasnick A superb explainer and analysis. Thank you.
@mmasnick well written piece & bookmarking to read again in the morning. Thanks for sharing.
@mmasnick Thank you for this. With respect to the comment about whether there are any lawyers left to put together the documents necessary to comply … the significant hurdle here is actually engineering compliant products (and I have my doubts wrt to the current Twitter). Documenting compliance rests on the premise that there is a robust development process and a well engineered product that can be documented.
@mmasnick read that. Good article!
✌🏼🙂👍🏼
