the way mojang's eula is constructed is that it strictly prohibits you from monetizing copyrighted/trademarked minecraft material or modifications you make within the minecraft ecosystem. anything beyond that is not part of the legal agreement, and is covered either by the "guidelines" (which mojang claims to be extra-legal) or separate agreements with mojang in writing (if you're a big enough company).
whether this would hold up in a court could be a valid question i suppose, i'm not enough of a lawyer, but someone who invested a lot of money into extending a copyrighted work with such unclear terms of use should've paid lawyers before, not after getting concerned over another server (not even their own) getting in trouble with mojang (contradicting their own argument that mojang doesn't do anything about servers breaking their extra-legal terms - which they can trivially disprove with years of backlog and the technical solutions in place for punishing unruly servers).
don't build businesses on work that can be pulled from under you, and congrats on getting $100k from the #saveminecraft crowd. try nintendo for $300k
