Rather than completely eliminating the normative state, the #Nazi regime slowly created a parallel zone in which “unlimited arbitrariness & #violence unchecked by any legal guarantees” reigned freely. In this domain, which Fraenkel called the “prerogative state,” ordinary #law didn’t apply.
