Reflecting on Canada's Charter of Right and Freedoms and the 40th anniversary of its section on equality rights

The rights require an equal impact on the person who would be affected by the law, and the scope of it isn't exhaustive either

This means it's almost impossible for the Canadian government to conduct itself like it's southern neighbour executive branch is so aggressively doing now

It's yet another way #Canada is distinct

#Canadians NEED to be aware of this! This isn't the first time #PierrePoilievre has taken DIRECT aim at the #CharterOfRights and it certainly wont be the last if the fellow nepo baby and Trump enthusiast is elected. #Canada deserves better. Vote @mark-carney.bsky.social #ElbowsUp #Cdnpoli

So it's an interesting thought experiment that I don't expect to see anytime soon. But imagine the stability of our society if we eliminate a tremendous amount of stress related to simply trying to live. And, perhaps, it moves us another step closer to transitioning away from capitalism towards cooperative capitalism. But that's a topic for a future rant.

Stepping off the soap box...

Warning- Incoming Rant
This rant has been marinating for several months. Back in September, I got into a spirited discussion about social programs with a golf buddy. "Spirited" is a great summary. He was a former CEO of a very large company prior to retirement and leans a bit more to center right. The friendly argument was about what rights and social programs should exist in Canada. Friendly banter amongst our foursome included referring to me as a "commie."

@JonathanMosen

Thank you so much for drawing attention to and sharing your experience of this.

I can appreciate that it is all the more hurtful to know that the checks in the system that exist to uphold values and correct unconscious bias and systemic abelism in language failed so utterly in a speech by the Prime Minister that was intended as an apology for historic abuses. I can only imagine how it was to experience this first hand.

@Crispius Scares the hell out of me. Someone posted the other day that a change in the #CharterOfRights needs parliament majority PLUS 7 provinces. We're at 6 right now. Scary prospect.

Interesting Ontario Appeal Court decision from yesterday that hasn’t yet had much pick-up in national media.

“Because the border is not a Charter-free zone, it is also not an almost-anything-goes zone,” wrote Chief Justice Michael Tulloch in a 114-page decision released Friday. . .

The law allowing Canadian border officers to search people’s personal devices is unconstitutional, Ontario’s top court has ruled, giving Parliament six months to come up with new legislation. “

An interesting Supreme Court of Canada decision related to the Charter of Rights and Freedoms.

Terms in a collective agreement do not override the Charter.

Supreme Court rules Ontario public school boards are subject to Charter of Rights | CBC News

The Supreme Court of Canada ruled Friday that public school boards in Ontario are an arm of government and they cannot "disavow their constitutional obligations" under the Charter of Rights and Freedoms, regardless of the terms in a collective agreement.
