Cole is charged with transporting an explosive device in interstate commerce & attempted malicious destruction by means of fire & explosive materials.

He is expected to appear in court Friday afternoon & has not yet entered a plea.

While Trump’s speech on #Jan6 clearly met the #BrandenburgTest for “seditious speech" & “imminent lawless action" – this I don’t think does. It’s insane, hella messed up & while logically anyone running for US govt office should automatically adhere to the US Constitution, this is probably not provably inciting, just seriously foreboding. If he were to become president again… very bad things.
