La riforma messa in campo “svilisce la rappresentanza parlamentare con le liste bloccate” e può dare “un premio eccessivo alla coalizione vincitrice, opera l’attribuzione del premio al Senato a livello nazionale” e questo rischia l’incostituzionalità, “non assicura coerenza tra le due Camere, viene presentata a ridosso della fine della legislatura rischiando di violare” le prescrizioni del Consiglio d’Europa”. Lo ha detto Fulco Lanchester, professore emerito di diritto costituzionale italiano e comparato presso Università di Roma Sapienza, nel corso delle audizioni in commissione Affari Costituzionali sulla legge elettorale, in corso alla Camera dei deputati.
“Un simile drastico giudizio sul progetto – ha aggiunto Lanchester – non significa che non si debba intervenire, ma non certo su una linea che ricorda nell’ambito della crisi del parlamentarismo di un secolo fa, le proposte che portarono alla legge Acerbo e alla legge sul primo ministro e segretario di Stato del 1925”.

The reform implemented “demeans parliamentary representation with closed lists” and can give “an excessive prize to the winning coalition,” it operates the attribution of the prize to the Senate at the national level, and this risks unconstitutionality, “it does not ensure coherence between the two Chambers, it is presented at the close of the legislature risking to violate” the prescriptions of the Council of Europe. This was said by Fulco Lanchester, emeritus professor of Italian and comparative constitutional law at the University of Rome Sapienza, during the hearings in the Constitutional Affairs Committee on the electoral law, currently being debated in the Chamber of Deputies.
“Such a drastic judgment on the project – Lanchester added – does not mean that intervention should not take place, but certainly not on a line that recalls, within the crisis of parliamentarianism of a century ago, the proposals that led to the Acerbo law and the law on the Prime Minister and Foreign Secretary of 1925.”
