The Federal Trade Commission wants to prohibit non-compete clauses in employment contracts with very few exceptions. It would also terminate existing non-competes 180 days after the new rule goes into effect.

The FTC estimates that workers will benefit to the tune of $250 billion or more.

Expect fevered opposition from business interests, including legal challenges that will no doubt invoke the new "major questions doctrine."

A terminally ill man procured insurance and then, using a broker, sold that insurance to a third party who knew of the man's illness. After the insured died, the insurer refused to pay, citing a Georgia public policy against wagering on human life. Psych! There is no such public policy, says the 11th Circuit, after certifying the question to the GA Supreme Court. #law #insurance #contracts #appellate #litigation

Important decision out of the Cour de Cassation. Court refuses to enforce an international arbitral award on public policy grounds. Reviewing evidence not presented to the arbitral tribunal, the court found that enforcing the award would allow the plaintiff to benefit from money laundering. #law #arbitration #InternationalLaw https://lawprofessors.typepad.com/contractsprof_blog/2022/12/cour-de-cassation-vacates-15-billion-arbitral-award-based-on-international-public-policy.html

Tesco faces a landmark lawsuit in the UK from 130 former workers at VK Garment Factory in Thailand, who produced F&F clothes and report being trapped in effective forced labour, working 99-hour weeks for illegally low pay in appalling conditions.
