Congress may have the constitutional power to do this, but as we’ve seen with SCOTUS, the anti-Constitutional wing is dedicated to the idea of a unitary Executive with unlimited powers.

If Congress was really concerned about this, they should never have passed the Authorization for the Use of Military Force after the 9/11 attack.

All that did was make it easier to dodge the issue and let a President do whatever they please.
