@AnnemarieBridy @bergmayer Interesting. In your chain of copies, you think the first silkscreens were sufficiently transformative, but not the downsampled copy licensed to the magazine? What I've been mulling over is whether I think the right policy would be some sort of exhaustion or fruit-of-the-fair-tree rule by which future downstream uses of fair-use DWs generally couldn't be found to infringe the original source.
@AnnemarieBridy @creativecommons I finished reading this morning and agree. Lots of ink spilled and lots of sniping here for an opinion that only addresses the first factor and claims to be holding narrowly for this particular licensing use.
