If the DEA is assessing a Schedule III determination, they would need to pursue exactly the sort of diplomacy that this article discusses. Otherwise, I worry a Schedule III determination would never hold upon a prohibitionists-supported appeal based by all prior legal findings.

The FDA took about 9 months (Sep. 17’ to Jul. 18’) to process the first New Drug Application (NDA) for a cannabis-based drug (Epidiolex). The DEA then took 3 months (Sep. 18’) to approve the Epidiolex rescheduling from I to V.

Assuming the cannabis rescheduling effort follows a similar ratio of FDA-to-DEA timelines, we could expect a DEA report to the federal register by the end of the year.

Let’s see if this timeline holds, or whether DEA slows down. Given the expedited nature of this rescheduling review, I doubt I’ll be too far off the money. The big question is how will FDA enable consumers to legally access cannabis as a Schedule II or III drug. That process might take another 9 months. Either way, I believe we’ll see federally-legal medical cannabis by the 2024 presidential election.
